Ok so let me repost this maybe I was miss understood. I had my interview 13 Jan and everything went great. I was approved the women that did my interview was very nice and asked me to tell her our love story, loved the story and asked for some pictures. I showed her our pictures and she said well Yasser all your papers are in order and they look great. You are approved, congratulations and good luck in America. She said sign here on your DS230 swear that all is true and u are good to go. Before I signed the DS230 she asked me to send her my wife’s 2008 tax return papers. Once I got my wife’s 1040 to send those papers and my passport and since I am approved they well just send my visa DHL within 5 days…

Now my wife when we sent in Affidavit of Support we only sent in 2007 tax year. Is this why they are asking for 2008 also since we are in 2009 and she only sent in 2007? My wife makes 125% above poverty line. Out of the 4 checks she gets a month 2 she files for taxes and 2 she doesn’t because those two taxes are not taken out. So her taxes don’t show 125% but when adding the other papers of financial support she makes way above. When we sent our Affidavit the first time everything was good because we didn’t get asked for anything additional. We sent in tax papers and also other proof of income equaling what is needed. We can do the same now.

---Once approved and DS230 is signed and DHL is paid can the embassy change their mind? This is just a general question…..

--- If she didn’t make enough in the first place would they have given me an interview or approved me how they did? Wouldn’t they have sent me a RFE to submit co-sponsor or proof of more income before they approved me?

--- We know she makes what they are asking for just we have to write everything out for them to make sure they don’t get confused. Taking her tax papers end year income adding her child support and V.A pay to that makes her have way above 125%. Since she doesn’t pay tax on Child Support and V.A we don’t put that in her tax papers to file.

So just wanted someone’s opinion.

Congrats.

To me it seems like they want to make sure that for 2008 she did make generally the same as 2007 and recent pay stubs suggest it was less, so that it is all accounted for appropriately they want the latest. I imagine that's fine and she will have to wait for her 2008 W2's to send them along with whatever court ordered documentation shows her other household income from other sources.

It seems they just want to verify her recent income. Did she include anything for 2008 other than the information on the 864? like letters from her employer ect ect.

I guess, if she did not send anything other than 2007 income's verification they are thinking, and reasonably so; she can write anything on the income line so they must verify it. For all they know she is unemployed.

I would have your wife call and ask if she can provide any other proof other than the 1040, like an employer letter with recent stubs included. Ask the employer to add the 2 weeks on 2 weeks off taxes scenario also.

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.
