Hi,

As a new person to the site, I just wanted to say thanks for all the great info. that's available here - it's been very useful.

I'm about to start the K1 process with my U.S girlfriend and have a question regarding the Affidavit of Support.

I realise this comes later down the line during the AOS, but it has me confused anyway.

Must the US citizen prove they can support the finace(e)?

My girlfriend is a student while I'm in full-time professional employment, so I'm the one with the money, so to speak.

This page http://www.usembassy.org.uk/cons_new/visa/iv/faffidavit.html seems to suggest that I could provide evidence I can support myself, but everything else I read suggests that an I-134F MUST be filed, showing the US citizen can support the fiance.

If it is indeed the US citizen who must provide the evidence, could I simply make a sufficiently large transfer into her bank account in advance?

Apologies if this has already been answered before, I did do a search but couldn't find the answer.

Your income only counts if it will continue once in the US. Or if you have assets that can become liquid soon.

Yes, you must file an I-134. Your fiance will always be your primary sponsor. Look into getting a secondary (joint) sponsor if he does not meet the income requirements.

You can transfer money, yes. London seems to be pretty lenient on the financial end but having an I-134 is a good idea even if the income shown is insufficient. The problem with the foreigner self sponsoring is the income doesn't count unless it will continue from the same source after you immigrate. As a K1, you'll enter without work authorization (for all intents and purposes, even if you get the 90 day stamp at JFK) so assets would need to carry the day or you'd need to convince the CO the public charge concern is nil. That's really the issue. If you can convince the CO you won't become a public charge, they have a lot of latitude.

Facts are cheap...knowing how to use them is precious...
