I got married before the 90days but my wife's I-94 was expired. Can I still submit my AOS?

As a USC you do not submit the I-485 (only the I-864 is provided by the USC)... Your alien wife however does... and yes it is still OK

YES you can submit your wife's AOS anytime, the only requirement for K1 Visa Holder to be legible for AOS is for them to marry their petitioner within 90days from date of arrival in the USA. As long as you comply with that condition you can apply AOS whenever you are ready!

AOS interview on 04/30/09

EAD Card production ordered on 03/17/09

EAD Card received on 03/21/09

AOS interview APPROVED on 04/30/09

Card production ordered on 05/27/09

Welcome letter received on 06/05/09

Card production ordered again on 06/15/09

Permanent Resident Card received on 07/09/09

I-751 ROC TIMELINE

I-751 package mailed on 02/28/2011

I-751 package delivered on 03/02/2011

Check payment cashed on 03/04/2011

NOA1 received on 03/08/2011

Biometrics appointment on 04/05/2011

Card production ordered on 05/06/2011

I-751 Petition Approved on 05/06/2011

k1 visa is not valid after it's first and only use

03/01/2007 - POE - JFK (L-1 Visa)

01/15/2008 - Proposed

03/15/2008 - Married

09/02/2008 - Sent AOS Package (I-130, I-485, I-693)

09/03/2008 - Received - Signed by SMITH

09/04/2008 - Checks deposited

09/10/2008 - Checks cleared ($1010 + $355)

09/12/2008 - 2 NOA's received (I-130, I-485) - Dated 09/08/08

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

yes you can file or submit your vchange of status even her visa is already expired.Like mine I came her last April 18 and married May 1, 2008 .My visa was expired last august 12, 2008 and we filed the change of status last october 29, 2008..So no worries about of filing of status as long as you are now married.

Yes you can... file your AOS.. We did the same thing! Our I-94 expired in September and we just filed in December. Get your papers together and go ahead and File away!

03/02/09- AP received via USPS

03/05/09- EAD received via USPS

04/27/09- Received CRIS email - Green Card has been ordered on 4/25/09- Petition Approved!!

04/28/09- Received CRIS email 'Welcome Letter' mailed

05/04/2009- Conditional 2 year Green Card received
