Debate has ebbed, but will it pick up?

Talk about illegal immigration has ebbed in the last year, but some Texas lawmakers aim to revive discussions by proposing more than a dozen bills that, among other things, would punish employers for hiring illegal workers and challenge the U.S. citizenship of illegal immigrants' U.S.-born children.

Other bills filed for the 2009 Legislature would require public schools to maintain records on students' immigration status, impose a fee on money wired to Latin America, require identification from voters at the polls, prohibit parole for illegal immigrants and create a state criminal trespassing charge for illegal immigrants enforced by local police.

Several of the proposals are similar to ones that were introduced in the last session but failed to make it out of committee because they were considered unconstitutional.

"In some ways, they follow an old pattern. A lot of bills will be introduced," said Muzaffar Chishti, director of the Migration Policy Institute at the New York University School of Law. "And they will be introduced again for the same political motivation by the same cast of characters. The issue is, 'Is it more likely that they'll get passed this time?' "

How are they going to challenge the citizenship of illegal immigrant children? Presumably the automatic citizenship is a Federal law...

This issue is brought up by all those state reps from east and north Texas every year, and it will fail the same way. Same ol' same ol' :whistle:

Paul, have one on me...You are right by gawd...The 14th Amendment to the U.S. Constitution needs to be changed

in order to revoke citizenship to anyone born in this country. I am not a lawyer. I was taught this in grade school..Such

capricious racist tone of Texas in even saying that in public...

For one second, think. Do you know what it take to amend the 14th Amendment, the most cherished of all our legal

Seriously, on terms of immigration there is a constant battle between the rich "cowboys" of the north against the representation of the south.

The fence is a joke, I see it on a daily basis and the ways illegal immigrants sneak into the US are so intricate that a mere fence won't stop them. To me the fence does the same job that toupee does for a bald man, gives peace of mind even though he knows the problem won't go away miraculously.

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article."

Came about because southern states were not considering slaves as US citizens, this amendment changes that. The slaves had a long history in this country, even before this country was formed. After this country was formed, the slave trade greatly decreased. And in view of the injustice in this country at the time, a slave owner not only owned he slaves he purchased, but all of their offspring as well, giving just cause for the passage of this amendment at the end of the civil war.

Now what this has to do with illegals coming here and having babies that are considered USCs', taking advantage or basically state supported education and Medicade, is well beyond my legal mind. It's up to the supreme court to make the correct interpretation.

In the case of illegal aliens, their native country has a claim of allegiance on the child. Therefore, some Constitutional scholars argue that the completeness of the allegiance to the United States is impaired and logically precludes automatic citizenship. However, this issue has never been directly decided by the U.S. Supreme Court.

The Price We Pay "Make no mistake, Americans are happy to welcome immigrants who follow our immigration laws and see a better lifer here. America is far more welcoming and tolerant of newcomers than any virtually any nation on earth. But our modern welfare state creates pervasive incentives for immigrants, incentives that cloud the issue of why people chose to come here. We cannot afford to open our pocketbooks to the rest of the world. We must end the pervasive incentives that encourage immigrants to come here illegally, including the anchor baby incentive. "

The nation's school system faces the economic burden of providing services to the millions of children born to illegal immigrants. In a 2004 United States General Accounting Office report, three states submitted their annual cost estimates of educating illegal children. The estimates provided ranged from 50 million dollars to 87.5 million in Pennsylvania and 932 million to 1.04 billion dollars in Texas.

FAIR estimates there are currently more than 425,000 children born to illegal aliens each year. This figure is based on the crude birth rate of the total foreign-born population (33 births per 1000) and the size of the illegal alien population (13 million in 2008). In 1994, California paid for 74,987 deliveries to illegal alien mothers, at a total cost of $215.2 million (an average of $2,842 per delivery). Illegal alien mothers accounted for 36 percent of all Medi-Cal funded births in California that year and now count substantially more than half.

What Does This Mean?

Higher Taxes: The federal government has control over immigration law for the United States. By not correcting this mis-application of the 14th Amendment, the funds that state and local governments must provide to anchor babies amounts to a virtual tax on U.S. citizens to subsidize illegal aliens.

Disrespect for the rule of law: Congress, by failing to act on legislation aimed at correcting the interpretation of citizenship by birth, in effect rewards law-breakers and punishes those who have chosen to follow the rules and immigrate legally.

The original intent of the 14th Amendment was clearly not to facilitate illegal aliens defying U.S. law and obtaining citizenship for their offspring, nor obtaining benefits at taxpayer expense. The United States is unusual in its offer to extend citizenship to anyone born on its soil. Other developed countries have changed their citizenship practice to eliminate the problems caused by the practice of birthright citizenship.[1] The anchor baby problem has grown to such large proportions that the United States can no longer afford to ignore it. The logical first step for correcting the problem is for Congress to adopt legislation clarifying the meaning of the 14th amendment."

Our governor claims the major portion of his 5.6 billion debt is due to Medicade and education, practically all the babies born here from illegal parents I have heard about are on Wick and/or Medicade payments. This gives ample motivation for even very young illegal girls to become pregrant. Some as young as 13 years of age. Ha, as a USC of my state, don't get tempted by this, you will not only face statory rape charges, but lifetime child support of that child. But young illegal girls are easy.
