We received the Biometrics Appt, EAD and AP and then received and RFE for the lost medical. I know another couple that had the same instance. At that point in time it wasn't a big situation because he was able to work and travel if an emergency occured. We then had 30 days to turn in the new medical examination paperwork.

Thanks Tasha, in that case I'll be just fine with an RFE! If he had the EAD they could drag this out for 3 more months and we wouldn't panic. I'm amazed at how fractured this process is... like an entire workshop of developmentally delayed elves are chinking away at this from 20 different angles... Oh I forgot, these are the same folks who buy $400 toilet seats.. ;)

It is unusual that you have not yet gotten a biometrics appointment. It doesn't mean anything as far as whether you will get an RFE, but you may want to try calling or getting an infopass appointment to check on that.

It is unusual that you have not yet gotten a biometrics appointment. It doesn't mean anything as far as whether you will get an RFE, but you may want to try calling or getting an infopass appointment to check on that.

Called last Friday and they said "you should have had your appt. about 30 days after you filed", like we forgot to do something!!! They gave us a Reference # and said if we didn't have it in 45 days to call back... Our 90 days is up in about 10 days... we made an Info Pass Appt. for next Friday.

Anyone know if it's possible for the local office to do anything at all for us? I read somewhere that a Temp. EAD after 90 days is possible.. but don't see any info about how to do that anywhere.

Local offices stopped issuing temp EAD in Sept 2005 all they can do is send a request to the service center asking for a decision to be make on your application for EAD.

I would be more worried about your lack of biometrics appointment. Calling the 1-800 line is a bad idea as all they are is a call center they are not USCIS employees and they can only see the same amount of information you can on the website, they will send a service request to the office dealing with your case that might get looked at a few months down the road. That is why they tell you to not call back for 45 days.

The officer you speak to at your infopass appointment will be able to sort out your biometrics and get you an appointment.

Well calling them certainly didn't HURT me... not sure if it helped or not... but here's what DID Help...

I contacted my Congressman. His assistant (that deals with the USCIS) contacted me yesterday and said he had put in a request for information to the NSC and would get back to me as soon as he heard something.

Today he called to let me know that they told him a Biometrics Appt. was scheduled for Feb. 10th (we never rec'd any notice if this appointment!). He told them that actually TODAY was a better day to do my husband's Biometrics... so at 3:00 pm we completed them in about 10 minutes flat.

We got home and opened our email to find a status change had occured on his EAD case between the time we left (3:00pm PST) and when we got home (6:30pm PST). We were notified via their email system that his EAD had been approved and "Card production ordered". :dance:

How and why they approved the EAD before they even KNEW he had his Biometrics is beyond me... Since our case is handled in the midwest they should have been closed at the time he had his Biometrics done...

Oh well, we are done with Biometrics, the EAD is approved, and now I only have to figure out how I'm going to discover the date and time of an "appointment" related to the I-485 that the Congressman's assistant was told has been scheduled.

According to his source they sent us a letter notifying us of an "appointment", but we've rec'd nothing from them and there no info on the online case info page about an appointment.

I'm assuming this is an Interview? What other kind of "appointment" could they be referring to???

Guess the nice man at the Congressman's office will get to talk to them AGAIN! :whistle: Sure glad to live in an area where such great service is given to the congressman's constituents!

If all else fails, we still have that time slot for Info Pass Appt. on Friday, maybe they know what appointment we're scheduled for.. but at the rate we're going he might have his green card by then! :dance: Go figure... :dancing:
