Timeline

My wife and step daughter got thier green card a few weeks ago. We just contacted a lawyer for the adoption process. My wife told the lawyer she knew the name of the bio father but she didn't know where he was now. He left before she gave birth and has not made contact for the last 5 years. My wife said the father has no rights in Peru because his name is not on the birth certificate. The lawyer said the law in the state we live in, the father has rights and we need to make an effort to contact him. If we can't, an ad in the local newspaper in peru needs to be posted. My wife did make an effort to contact someone who might know where he is, But said if she really tried hard she might find him. But the thing is she doesn't want to find him. Does anyone know the adpotion process. Will the court try to contact him? What are the consequences for not providing all the information available?

Your lawyer there in PA is far more qualified to give you advice about adoption in PA than anyone one this board. If you dont like the advice you are getting from this particular lawyer see another.

I don't think asking my lawyer if I'am breaking the law or asking how I can bend the truth a little is a good idea.

Why not? Discussions between you and your lawyer are confidential, and their job is to advise you, help you, and defend you, regardless of your actions or moral bearings.

Apr 30, 2008 -------> Forms received by USCIS

May 06, 2008 -------> Cashed check posted to account

May 10, 2008 -------> NOA1 received for EAD, AP, and AoS

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

I would go ahead and just place the ad in the local paper in I guess Lima or the city where your fiance is from.

I doubt very much that the biological father will see it and you have done what the lawer suggested and you've covered your bases.

AOS / EAD / AP and Remove Condition

3/06/06 - AOS/EAD/AP process begins

3/31/06 - AOS/EAD/AP package Fed Ex'd to Chicago

4/03/06 - AOS/EAD/AP package signed & received

4/10/06 - NOA1's received for AOS, EAD and AP via U.S. Mail

4/11/06 - All 3 checks cashed / $745.00 poorer but worth every penny

4/27/06 - Receive Biometrics appointment letter scheduled for 5/11/06

5/11/06 - Biometrics completed

6/02/06 - Receive notice that AOS only has been transferred to California to speed things along

6/07/06 - E-mail that AOS received in California

6/13/06 - Welcome letter mailed by California... yeah baby

6/17/06 - Official welcome letter received and card will arrive within 3 weeks

6/19/06 - Card arrived in the mail.......

3/08/07 - Trip back to Peru for 10 days and our Religous Wedding

3/2007 - We're Pregnant

12/19/07 - Sebastien Joshua born 8:29am 7lbs 2oz 19.5"

3/14/08 - I-751 Removing Condition is in the mail

3/20/08 - Checked cashed

3/17/08 - I-751 Package signed and received

3/24/08 - Case moved to Vermont

4/17/08 - Biometrics completed

4/21/08 - Touched...........

6/16/08 - Touched once again........

11/3/08 - Touched again.. this is begining to feel good

If the PA law requires you to place an add or do any other specific things in an attempt to contact the father, you're going to have to show concret evidence you did so. There's really no getting around it. This is an issue for your attorney.

the court aint gonna do jack diddley...its not their job. In the US jurisprudence system, when an action is file in court, all of the relevant parties have to contacted, so they can answer the complaint/action. This has to be done thru legal process serving. If he isnt available, then Im sure that your state allows service of notification in the legal section of the newspaper where he last lived. The newspaper has to furnish an affadovit that they published the required legal notice in the paper. I doubt that some newpaper in peru is going to do this. You almost have to make personal contact, and have him sign his paternal rights away.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

We're not too worried about running an ad in the paper. It's unlikely he will see it. We're just worried the court might try to look for him, but I would imagine they would not go to the expense to do it. My wife is worried she will get into trouble for lying, when she says she did everything possible to find him, when she did not. I tell her to stop worrying.

I don't think getting proof the ad was printed will be a problem. We could always have the newspaper mailed to us as evidences.

We're in the same boat. I searched for adoption process here and this is what I found. I also don't have my son's biological father's name on his birth certificate. In fact, the father section of his birth certificate is blank cos we broke up when I was still 3 months pregnant and since then, I don't know where he's at.

There should be another option than finding the guy cos what if we really can't find him and who knows he's already 6ft below the ground.

I hope somebody here can be able to give us an idea how to do the processing and such. Btw, Maju, have you tried contacting USCIS about how the process is done? I haven't. We're still in our process of getting our GCs right now but I wanna plan ahead.

Feb 07 - met my Dream Guy

Jun 08 - arrived in the US

Jul 08 - ♥♥♥ WEDDING DAY ♥♥♥

Jul 09 - Temp GC received

Mar 12 - 10 yr GC received

Aug 13 - Naturalized

UPDATE and new question,

The judge handling the case is being a pain. Our lawyer informed us that the judge is demanding us to find the birth father in order to make him sign the resignation to his rights (even when he doesn't have any legal rights in Peru). They don't give us any other option but find him to continue the process, but we don't want to find him, and we don't think we could.

A lawyer friend in Peru, is willing to do the adoption process there, where the father's approval is not required at all since his name is not on the birth certificate; but what we don't know is how to get the adoption validated here.
