Filing in January and Tax returns

Hi there,

My husband is ready to file my petition but it's the beginning of the year and he has not yet received his W2 and 1099 to file for 2008. May we submit our 2007 tax copy with our petition or should we just wait until it is filed in February to submit last year's copy?

Another question is: Should we make two checks to the Department of Homeland Securities, the petition fee of $355 and the Biometric fee of $1010 or just place one check of $1365 in the envelop as all documents are being mailed to the same address (I-130, G-325A, I-485, I-693, I 864 and I-765)?

I take it you are adjusting status, not petitioning for a visa process, so no foreign embassy will be involved. If you're filing now, you can go ahead and us the 2007 return and then take the 2008 return with you to an AOS interview if there is one. Yes, write two separate checks but everything can go in the same envelope.

Another question to you if I may: For some application they ask for the same copies. seeing that it is going in the same envelop do I need to make copies as per application or one copy will suffice? For example. I-130 and I-485 both need copies of marriage license and divorce documents as well as the G-325A. I will be mailing everything on 01/17/2009 and need an urgent reply. Thank you so much.

thank you for responding. I have been married almost two years now and I live in the US. I am not filing for a visa but to adjust my status to permanent resident. We are just beginning our petitioning process due to my husband's illness which had to be prioritized.

Except that you may mail them in the same envelope, treat the I-130 and I-485 as separate files. Separate marriage license and divorce copies and separate G 325a forms. Note the G 325a for the I-130 will be different in the bottom left where it asks why it's being submitted. One will say for I-130 and one will say for permanent resident status.

Thanks so much. So should I mark "other" on the G-325A in relation to the one filed with the I-130 and state it is to petition for Alien relative?

Other, yes but you won't have room except to type I-130 in the space provided.

Thanks. I did as you said and copied every document requested for each application. I am about to write my cover letter, make sure every document is signed and mail it by tomorrow the latest (too nervous to mail it out today, I have to go through it with a fine tooth comb one last time )

When filing a petition, your husband has the option of filing the last three years of tax returns 2006, 2007, 2008 - or - just 2008. However, since it is the end of the fiscal year 2008, the USCIS will be looking for that year and will request it. So it is better to wait on th petition until you get the 2008 Federal taxes filed so that you can submit a copy of it with the petition.

Also, I believe it is best to submit two money orders for the two different fees. One for the petition. One for the biometric. Note on the money order your case number and what the check is for - biometric fee - petition filing fee.

When filing a petition, your husband has the option of filing the last three years of tax returns 2006, 2007, 2008 - or - just 2008. I submitted only one check for fee + biometrics... no issue
