Now that we have sent our I-130 petition and we are waiting for our noa1, can i ask for a tourist visa to visit my husband while our case is pending???

anyone of you tried this solution to be together until the i-130 approval???

please help

absolutely no, otherwise your application would be jeopardize. i had read it somewhere here before, that it might even led to jail. you can apply only one visa at a time. i hope this helps.

absolutely no, otherwise your application would be jeopardize. i had read it somewhere here before, that it might even led to jail. you can apply only one visa at a time. i hope this helps.

This is not true. You can apply, but your chances for denial of the tourist visa are much greater now that you have shown immigrant intent. It will be much more difficult to convince the embassy that you will return to your home country.

sorry thats not possible. i have a tourist visa and was told not to use it once we file the whole petition.

and when i passed the interview, the consul told me that he was gonna cancel my current visa to be replaced by the K1 visa.

Sorry, the simple answer is no, you cannot visit your fiance while your application is pending. Be it justified or not, visiting the U.S. on a non-immigrant visa while an immigrant visa is pending is not allowed. Doing so would force the immigration officer to assume you are going to say "screw it" and stay there.

Separation is the worst part of the application process, but we've all been through it (or are going through it). Convince your fiance to visit you instead :)

Not sure if it's the same if you are petitioning for a spousal visa but those with a petition for a fiance(e) visa can visit. You will probably have to show sufficient ties to your home country though.

Actually that's not true.. you ARE allowed to visit while your application is pending (and there are spouses that do), BUT you will need a tourist visa to do so and it will be very hard trying to get one now that you've shown immigrant intent. Not many people are lucky enough to get a tourist visa.. you can try if you like though, you need to provide evidence of ties to your country but understand that it is unlikely that they will grant it.

Is it possible for your husband to visit you there?

I tried in manila to get a tourist visa for my wife with the explicit intent to file for her k3 written on the visa, they denied her right off the bat, no other questions asked, they just stated that she can not have a tourist visa if i was applying for the k3

why dont you just ask your husband to come visit you? thats what im going to do, file my I 130 and 3 -4 months planning a trip to see my husband...

I visted my husband in the US about five different times during the visa process after we had applied for the CR1 visa. (using VWP)

You are allowed to visit on a non-immigrant visa while applying for an immigrant visa.

However...

- if you don't have access to the VWP and have to apply for a tourist visa, it is very likely that you will be denied the visa because of the immigrant visa application. (some people have been successful - it's a risk you take that you will lose the visa fee if they deny)

- even if you are successful and have either a tourist visa or can use the VWP that is no guarantee that you will be allowed to enter once you get to the US. If the IO suspects you will not return to your home country they can deny you entry. Always take lots of evidence of return to deal with this scenario.

I think some consulates/countries do discourage any visiting during an immigrant visa application which is why some people here are convinced it's not possible. You should try to find out from the Embassy / other applicants from your home country if there is a trend to allow/not allow tourist visas for immigrant visa applicants. It clearly differs from place to place.
