When do I get marriage certificate for AOS application?

Hello.

My K-1 is approved and ready to head to the USA for the marriage ceremony in April.

So, my question is, if I need to file for AOS before the K-1 expires after 90 days, and I was told that we will not receive the Marriage Certification until a few MONTHS after the ceremony, how can I send the Marriage Cert for immediate AOS application???

The Department of Health does not mention this; just says the Marriage Cert will be sent by mail about 2 or 3 months later.

Please advise.

PS -- we are getting married in Honolulu.

You only have to get married with in the 90 day period. You have LOTS of time after that to apply for AOS.

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

The marriage certificate is prepared and filed by your licensed marriage officiant or performer with the Department of Health. A newly married couple receives one (1) certified copy of the marriage certificate at no extra charge, upon payment of the marriage license fee, which will be sent to the couple by mail (60-120 days) after the marriage has been performed. If a marriage certificate is needed sooner than this, you can apply for one or more additional certified copies.

[i am not sure what they mean by the "apply for one or more additional certified copies" and the link to the Web page they provide does not describe that in detail.]

The phrase, "if a marriage certificate is needed sooner" implies there's a way to expedite it. Contact them directly for your answer.

Normally the marriage certificate is not filed with the Department of Health, but with the court house that issued the marriage license. Maybe Hawaii handles this differently, but I would a different source of information.

Ours took one! day to be filed and we got the copy immediately.

Usually the one who perform the marriage ceremony (county judge, pastor, priest, etc) will mail the marriage license back to the county court house (to the county court house where you get your marriage license). After they receive it, you can go to your county court house and request for certified copy of your marriage license. You will have the certified copy on the same day and use this certified copy for your AOS.

State of Hawaii charges a fee to issue a certified copy of the Certificate of Marriage prior to the normal period of 120 days. The fee is $10; once the license is entered into the system, you can pick-up the copy in person or have it mailed to you in 7-21 days. The State will provide a green order form with the license. Normal processing of filing takes 3-7 days; a certified copy is automatically sent after 120 days if you don't ask for the expedited copy. For residents of foreign countries, an Apostille is available for $1. This is a separate fee & cannot be combined with the expedite fee. If paying by Money Order, you'll need 2: One for the copy fee & one for the Apostille. A Certified Copy is required for proof of Marriage & Change of Name. Vital Statistics Office closes at 4:00 PM.

In Kansas our Courthouse said just ask your Pastor to give you the papers after you sign them and submit them to the courthouse and they give it to you right then and there! When i was ready to file i couldn't find my extra copy so i just called the courthouse and they mailed it to me; it was in my hand the next day.

First of all, take a deep breath & relax.

Every state in US is different about issuing the marriage certificate.

I am sure your country, Canada is different too.

You do not have to wait for the sealed Marriage Certificate to apply for AOS.

Whoever marries you ( I mean in HI) signs the marriage license (not certificate)

along with the 2 witmesses' signatures & gives one of the copies to you.

Now, this document became marriage certificate (not license anymore after the signatures).

This is also an offical document, you can use it anywhere including AOS. Later on you can get the fancy

marriage certificate, that takes little bit time. It took me about 1 week to get it for example, I live in NJ.

I know it is confusing. Doet it make sense now ?

right about that....even the counties are different about how they issue licenses.. i got mine right after the ceremony at the courthouse. my friend who got married at a courthouse in another county had to wait till his was mailed. he was given a temporary one however at the time of his marriage.
