Hi Everyone,

Here is our problem. My wife and son had their

I-751 approved last July and got stamps in their

passport. They told us we would get the green cards

in 6 months. My wife got hers soon after that.

We've been waiting 6 months watching the mail

every day for my son's, but it never arrived.

So we submitted an I-90 in January to get another

green card, because the card was not received.

(You are supposed to get a free replacement in this

case).

Today we got a letter back from USCIS saying their

records say they mailed his green card on 3 September

and they did not get it returned back to them so we

must have received it. They tell us we have to submit

another I-90 under the category "lost, stolen, or destroyed"

(which would be a lie with our signature under it) and pay

another $260 for their mistake or the remote possibility

that US Postal Service lost it ...

Any advice on how to proceed? We'd like to sue them

and are pretty angry about all this.

One other wrinkle. Our son turns 14 in September

and we'll have to get another green card then anyway

and have to pay another $70 then (it is a $70 fee to get a

new green card when you turn 14). Does anyone know

what will happen if we do not have the old card, whether

they will let him get a new card for $70 without paying

the full $260? At this point it is unlikely they will get

us a card much before he turns 14 anyway.

What problems will he have if he goes without a card

for a few months? He is legally approved. We even have

this stupid letter from USCIS that they sent him a card

and saying that we lost it.

The same thing happened to me.... I did not receive my Greencard... I too sent off the I-90 with no fee because I never received the original and like you the I-90 was returned to me to refile and pay....

I have e-filed the new I-90 and pail the $260 because I just want this to be finished with....

But yeh I am pissed at USCIS too........

Hi,

I never received my Green Card I sent off 2 more times and still no green card,I found out they messed my first set of pictures up and after sending 2 more sets no Green card and that was back in May of 2004.

TSC told me my Green Card was mailed out and after making an appointment with Infopass and talking to an immigration person he informed me my card was destroyed because of the picture. I did not pay any more money out for their mess up.

I am now ready to remove conditions, I have sent them a copy of the stamp I had put in at the immigration office ion Dallas.

Fingers crossed they manage to get my new Green Card to me this time.....One can hope

Time Line:

12-09-03: Mailed I-130, I-485, I-864, G-325A, & I-765 to Dallas district office.

01-10-04: NOA.from USCIS for AOS

01-31-04:Apponitment for EAD

02-21-04:Received EAD same day

02-23-04 Applied for SSN

03-5-04 USCIS sent fingerprint notification for AOS

03-06-04 Collected SSN print out still waiting for card

03-11-04 received SSN card

03-13-04: finger prints for AOS

04-21-04 recieved AOS interview

05-21-04, 2004: Received I-551 (Green Card AOS Interview )

08-04-04 Green Card lost in mail returned to Immigrations and destroyed

09-03/04 apply for new Greencard had to provide new addit photo's would not use the other 2 of my originals, told I will receive my new card with in 6 months.

10-14-04 Case approved on line for replacement Green Card never received approval letter in mail.

2/26/05 still waiting and waiting for Green Card !!

2/16/2006 :Applied to remove conditional residency

3/16/2006 Conditional Status removed.

12/2/2006, Still waiting for Green Card

I'm sure you son can go without a green card for a few months, tha green card is just a proof of status, and his status doens't change even if he doesn't have it.

An idea could be to make an Infopass appointment to ask for a stamp, that's a proof of status just as good as the green card. Maybe you could take the NOA for your I-90 to prove that you requested a new card and the approval letter. With those, I don't see why they shouldn't give you the stamp.
