I'm trying to give some advice offsite to a girl who's considering some form of marriage-based immigration, and it transpires that she's in a lesbian relationship with a US citizen. Now, I'm pretty sure the answer is no, but gay marriage isn't recognized in any way by USCIS right now, is it?

I've already directed her to this site and I hope she comes and at least checks out some of the information, but I thought I'd ask on her behalf.

August 27th, 2008 - Biometrics Appointment

September 22nd, 2008 - Case transferred to CSC

October 3rd, 2008 - Case at CSC, Touched, Touched again on 7th

October 20, 2008 - AP and EAD Approved!!!

October 27, 2008 - AP and EAD Received!!!

December 19th, and 21st 2008 - Touched

January 26th, 2009 - RFE...

February 27th, 2009 - NOTICE MAILED WELCOMING NEW PERMANENT RESIDENT!!

March 6, 2009 - GREEN CARD RECEIVED!!! LPR STATUS NOW OFFICIAL!!!

i dont even know what states gay marriages are recognised?? thats so messed up that they dont have a more open mind.

Yeah, I wasn't really sure where to put this, just figured I'd put it here as the visa this person was considering was K-1.

And no, I didn't think it would be. Thanks for the info, though.

Immigration is a federal jurisdiction. Even though different states recognize same-sex marriages, the federal government doesn't, so no immigration route is possible through a same-sex marriage. There are other countries that do, so maybe one day, but not yet.

No, she's Dutch, from what I understand.

I don't really know this girl, I just happened to come across a thread she'd made on another site asking about how one would go about moving to America. She mentioned she had a fiance here so I suggested K-1 and checking out Visajourney, but then she said she and her partner were both female, which I was pretty sure would make K-1 unavailable to her. Turns out I'm right, unfortunately.

Would the girl in question, if Canadian be able to sponsor the American to Canada because it's legal here. Hmm.

This really shows how antiquated/old fashioned the immigration system is (not to mention the minds of some people). I used to think as a child the U.S. was the most advanced nation leading the world in freedom and justice. Ignorance is truly bliss. -Jeff

If she is Dutch they should be looking at the US fiance going to the Netherlands - same sex unions are legal there and a Dutch national is allowed to sponsor a same sex partner. Their relationship is only a problem if they are insistent upon being in the US.

It has nothing to do with the system being "antiquate", it is NOT legal at the moment. I'm all for gay marriage but you can't blame the system that is based upon US FEDERAL law in which it is not legal. If US law changes, then so will USCIS eventually.

australia allows immigration for persons in intimate relationship, and does not even require marriage.
