Yesterday I rec'd my NOA1 from my I-130 petition. Now I'm getting everything together to send the K-3 petition but I'm not sure if I need to sent a copy of both my NOA1 and a transfer notice or if just with the NOA1 it's ok?!?!? I just want to double check but technically the instructions for the I-129F state the following:

B. Form I-129F Filing Locations for K-3 Spouse

If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlying I-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

Notice is says: receipt notice OR transfer notice

Which means that it's one or the other. But the Step-by-Step Guide on How to File for a K-3 Visa for your Foreign Spouse on this site says you need both.

Can anyone confirm this for me???

Now, are your absolutely sure you want to send that I-129F for spouse? Have you been reading here about all the people who wish they hadn't? I don't recall whether the unique circumstances in the DR resolve this question with a yes or a no but I seem to recall they do resolve it pretty definitely. If so, maybe it needs to be repeated here.

No I haven't read about it. Is it not a good idea because of the country (DR)? Please explain if possible??

Nothing to do with the country. Many of us wish we never did the 129-F because it only delayed our approvals.

If you're filing with VSC, they take WAY LONGER than CSC. Since they are so backlogged, they were transferring applications for I-130 alone, to CSC. Those people were getting approved MUCH faster than the rest of us that had I-130 and I-129F together - who were stuck at VSC for the duration. Also, they are always approving both at the same time. So many people chose the I-130 because it gives the spouse the GC, whereas the K-3 is just a visa and later you have to adjust status, get employment authorization, etc. So many of the applicants felt the I-129F was useless, because it doesn't get approved faster.

So do you think that it's just a better way to go if I just stick to the I-130 and don't even bother with the I-129F? I just thought that if I put both of them in who knows which one can get my husband here somewhat quicker. K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

K3 will get to the US a little quicker. Sure won't get their GC or SSN faster and will end up going thru extra expense and hassle doing AOS.

I blew it and went with the K3. SURE wish I wouldn't have now.

No I haven't read about it. Is it not a good idea because of the country (DR)? Please explain if possible??

For the non-DR specific issues, I encourage you to read. I don't recall in which direction the DR specific issues weigh, so check the appropriate regional forum for that if somebody doesn't chime in.

Save your money, if I remember right it's like 1000 bucks or more so just stick with the I-130. From a prospective of which one is faster, your talking a matter of 30 days or so and a cost savings of over 1 grand. Plus your husband will be able to travel,work and be naturalized sooner then with a K3. This forum is a good resource to ask questions and no question is to stupid. This will help you speed your I-130 right through the NVC by having all your paperwork in order. Good luck in what your descission is.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

Thank you for the advise I just want to make sure I do things right. And we just want to be together, I'm sure you know how hard that is being away from your other half . So your saying that really the only difference is like 30 days or so. It's not that bad. Although it'll feel like for ever.

I don't know I've heard so many horror stories about how slows the process of the I-130 is and that minimum it'll probably take him to get here is like 2+ years. Thats cookoo. :unsure:

The cost savings is about $600, since the actual visa fees are higher for CR1 than K3.

However, there are Dominican Republic specific issues to check out before deciding. Do check in the appropriate regional forum.
