My wife and i are starting to fill out our AOS application. Now question about the G325 a form. Obviously now that we are married, i should put her new last name correct??/ i just want to make sure... also something else concerns me. now my and i got married on Dec 8 2008 and her I-94 expired december 24 2008. Will this be a problem now that we are just now filing after 3 weeks of her i-94 expiring?? thanks in advance for your help... god bless

Use the name that she wants to have on her green card because they will take the name from the forms, so if she is using her married name then enter her married name.

You just needed to be married within the 90 day time period before the I-94 expired so no problems - you were married in time. While it is ideal to submit the AOS before the I-94 expires, it isn't mandatory. Your wife's status expired when the I-94 did so she will have a few weeks of out of status time by the time you file the AOS. This shouldn't be a problem. Once you file her status becomes "AOS applicant" and she is again legal. Good luck.

Right... And since her name is now legally the married name, it makes sense that you'd put the married name on the application. I've seen people use their maiden name (and get their GC with maiden name), but never understood why.
