Has anyone ever gotten their petition for cr1 for spouse declined??

What I mean by "petition", in this topic, is =filing and not getting your case transferred to the NVC, or having the USCIS decline your petition.

Right, I've been told to make sure nothing is left out or done improperly in my petition as to not get it 'straight-up' declined right?? I'm sure everyone here has also been told the same....well...that's the point, really. But....I was just curious...has anyone ever actually gotten their petition for spousal immigration (preferably cr1) declined?

I'm sure if there are any at all.....at least a few must have been Pakistani petitions....what with all the need for such long AP's and the likes. Any Pakistani's.....would be grateful if you gave details...as many as possible. As to why, how, when, and what reasons for the decline.

Also, this post isn't just for those who got their petition declined first thing (meaning... either, USCIS declined or filing and not getting your case transferred to the NVC). This is for ANYONE and EVERYONE who has gotten their spousal immigration (cr1) case declined at all, throughout any part of this process. Please speak up....telling us what went wrong, or what the reason was may seriously help out us new filers quite some, I'm sure. So it would be really helpful of you. :thumbs:

Yeah, so basically......tell us when, why, where, how and whatever else you can as to why it went wrong....or what reason the USCIS, NVC or Embassy declined your petition or case???? Like I said, it would be a real help to us all. Thanx guys!!! :D

Any tips you guys can give would be really helpful....anything at all!!! With this whole process and how harsh it is on everyone, I believe even the smallest spec of hope, or help....can go quite a long way. :D Thank you.

first of all whenever you need help with what documentaions are required for a particular case your applying for: always call USCIS or NVC and tell 'em all the details about ur case and tell 'em that your mailing these documents, do i need anything else? they'll tell u right away and it's ur job to make sure all the documents are present and are according to what they tell you. You application will never be rejected, and that's my guarantee! tht's what i have been doing for my whole nanyaal's immigration case for 15 people together which completed along with successful visa's in hand about 4 years ago and my wife's immigration case which is in progress today. A lawyer is never needed for these immigration cases, they instead cause AP's and rejections of your case due to a document turned in incorrectly or form filled in incorrectly. anyways, getting to the point: i did investigate online to how long would it take if someone's rejected on the visa interview date, the officer who rejects the case says minimum time is 4 weeks and there is no maximum time to it and this may take years as well. What they do is run a few extra background checks and may ask you for a few more documents. I've seen people getting rejected: longest it has taken so far is 6 months.

When I-130 petitions are "denied" it's because either there's something about the couple that doesn't qualify, like one wasn't free to marry when they married or the marriage itself wasn't legal, OR the petitioner failed to respond to an RFE within the allotted. time. Most denials occur at the Consulate stage.

Facts are cheap...knowing how to use them is precious...

hmmmm....seems like not alot of people have gotten denied then. Seeing as the only people to reply are both talking about how less likely it is to get denied.....and making very valid and good points, at that.

Still...would love to hear from someone with the personal experience of a denial or decline. :hehe:

I'm very worried....

I am worrying quite a bit but I believe for all good reason.....I know I will be filing as unemployed but using a very good joint sponsor in order to balance that out. I mean, I can afford to support my husband because my parents are willing to help us out financially as much as we need for as long as we need....but they just don't want to become the sponsors for their own personal reasons. Other than that we already have jobs lined up for my husband, not to mention his all online business's, which never fail to put at least $5000 in the bank each month, plus the amount of support he has here from his relatives is tremendous. I just wish I could prove these things in the application...so that the unemployed bit would be somewhat less questionable. But the only types of things they ask in the i130 are, place of employment...emplyers name...and such. Since I will be putting N/A in most of the questions like this.....I believe that'll just get my petition straight up declined....seeing as they don't seem to ask whether you have a joint sponsor or not and they only care about YOU and YOU alone....thats what worries me.

Basically, I worry that since the form for filing asks nothing about the sponsors....the only things I believe they will see are the unemployed and the N/A's......I wish there were some place I could put that I have a very good and responsible joint sponsor and also have a place of residence and things like this. I just don't want my petition to get immediately denied the first glance it gets...

This is why I'm asking about whether anyone has actually gotten their petition denied....because I believe once you've gotten passed the USCIS part....everything's as near to smooth sailing from there as is possible. I mean, of course there are more and more chances of being denied and such from the nvc, embassy or consulate but, atleast from then on they know about the sponsor and everything and the pressure and attention gets pulled off the unemployed bit. Seeing as, even if I did get a job in Pakistan while I'm there, I don't think that would even count if I put it on the petition (that is if I decided to file from there. Since using DCF is impossible from pakistan....I think I will not be doing that. I'll have to file from here and then go.)

So yeah....if anyone can give me any details on their experiences with denials...especially if anyone can tell me what the chances are of being denied due to employment or the lack of it, really.....maybe that'd worry me down some... :dead:

This is why I'm asking about whether anyone has actually gotten their petition denied....because I believe once you've gotten passed the USCIS part....everything's as near to smooth sailing from there as is possible. I mean, of course there are more and more chances of being denied and such from the nvc, embassy or consulate but, atleast from then on they know about the sponsor and everything and the pressure and attention gets pulled off the unemployed bit. Seeing as, even if I did get a job in Pakistan while I'm there, I don't think that would even count if I put it on the petition (that is if I decided to file from there. Since using DCF is impossible from pakistan....I think I will not be doing that. I'll have to file from here and then go.)

This part is exactly backwards. The USCIS stage is the smooth sailing. Part of the reason it's smooth is you sail with no wind. No wind = smooth water. Risk of denial is mostly at the Consulate stage where you actually have to convince a human your relationship is bona fide, that there will be no public charge concern and that US National Security won't be harmed. USCIS deals with none of those issues.
