Filed I-360 after an approved I-130

Good day everyone,

I came to US on July 2006 from a cruise with a Tourist visa(expired end of July '06) and C1D, my I-130 has been approved since June 2006. Applied for adjust of status, had a very troubled and horrible life with my USC husband who's into drugs and child pornography. Has filed a few police report and a DV case was filed too, got a 2yr restraining order, he went to jail, bail out, case was dropped since they can't find me at the time of hearing (my husband hide me in his friends' house while cops are looking for me). Got back with him after 3mos. of counseling and guidance by teh family resource center. Continued our application for change of status, but late Nov. 2007 he went back to drugs, abusing me and internet child porns, he even locked me up for days in our apartment. I left, he cancel my application for I-1485(Change of status).

I filed for I-360 on June 2008, got my prima facie determination, but my attorney forgot to mention that I have an approved I-130 so my priority date from my I-130 should have been applied to my I360. My Atty. sent a letter stating that I do have an approved I-130. Renewed my prima facie determination, but didn't hear anything about transferring my priority date from an approved I-130 to my I-360.

Does anybody knows how USCIS process this kind of situation? I'm really worried now, cause I can't get much job to support myself since they won't give me an Employment card (My Atty. applied for EAD with my I-360, that was denied because my I-360 is still pending).

I search and search about this Priority Date, that you can carry out from I-130 to your I-360 and still can't get any answer.

This site has been a big help, thank you for all of you who wrote your stories and immigration process, my attorney initially told me that it shouldn't take more than a year, and that I can get an EAD after 3 mos....now I know the truth and I'm really worried how can I survive this journey.

Can somebody forward this to our new Vice-President Joe Biden? He came here to the VI during the holiday and if I could have possibly go to the island where he's staying, God knows I will do everything to bring this to his attention. I supported the Obama-Biden campaign, with my own little ways and little donations, I am a proud supporter of them.

Sept. 2004 - Met my now ex-husband

Oct. 2005 - Got married

June 2006 - I-130 approved

Aug. 2006 - Hubby became very abusive, alcoholic/drug addict, completely different person

- Went to the shelter, husband went to jail for DV

Oct. 2006 - Husband bail out, went to counselling and beg me to come back.

Nov, 2006 - I came back and started our life together. Husband change and treated me great.

Aug. 2007 - Husband started to drink a lot again and I found out he's abusing drugs again.

- We were ready to submit my I-485, paid the lawyer and then my husband wants to get my money back from the attorney so he can buy drugs.

Nov. 2007 - I left him and tried to survive on my own, working different jobs. My previous attorney gave me an idea about I-360

June 2008 - Finally saved some money to file for I-360

- A week after got a prima facie

Oct. 2008 - my attorney only filed for I-360 and I-765

- I-765 got denied since it should have been filed concurrently with I-485

Dec 2008 - Got an extension of Prima facie.

Apr 2009 - Finally got in contact with Catholic Charities in Miami (Heaven sent!) and they helped me submit my I-485 and I-765

May 2009 - EAD approved, got SSN

June 2009 - Biometrics done

August 18 2009- PASSED!!! Passport stamped!!!! it was just a 10mins interview....whew! the biggest journey is over...
