Ok, my RFE mail finally arrived and this is what they are asking for:

"Submit a copy of the applicant's birth certificate. If the document is in a language other than English, you must submit a copy of the foreign language document and an English translation."

So, I'm the applicant (I'm the foreign one), right? :hehe:

I did send my translated birth certificate, I didn't know I had to send the original one also, since this was made by a notary public... oh, God! Now I gotta look for my original birth certificate.

The message is pretty clear. What makes you think they asked for originals? They asked twice for "COPIES". There is nowhere in the mesaage that tells you they want originals.

They seem to have misplaced what you sent. Send your copies again. Make sure they are pretty good copies that you can read.

The translation has to be made by a certified translator. It is not enough to get it notarized after someone else made the translation.

The translator has to verify that he/she is certified to do the translation.

I'm sorry, by "original" I meant the one issued from my country, on my language - Portuguese. When I sent the birth certificate I sent just the translated one. Dumb me, I know, but now I'm sending everything they asked for - the one in Portuguese and the translated one.

My question is - Am I the applicant or the beneficiary? Are they really asking for mine or my husband's birth certificate???? (I promise I'll stop making stupid questions)

Stinger -- Mine was made by a certified translator, she put the seal and everything showing that she is certified. Thanks!

By the way, for Form I-130 they require the Birth Certificate of US Citizen (as a proof that he or she is a US citizen). And US Citizen is a petitioner for this Form.

If you send Birth Certificates and translations when applicable for both of you, you will be fine :)

These are not a stupid questions...I also find this to be kind of confusing :) Normally I would think applicant = US citizen, but in this case the RFE is for the I-485 (correct?), which you (the non US citizen) filled out, so I think you are the applicant they are referring to. Besides which, the US citizen does not have to supply a birth certificate as part of the Adjustment of Status application.

Earlier today I read about a somewhat similar situation, only it happened at an embassy at the time of the K1 interview; the K1 applicant brought only the translated birth certificate, not the original. She could not get the visa until her parents went to city hall, got a certified copy of the birth certificate, and then express mailed it to the embassy. So I am guessing that you are absolutely right in thinking that the RFE is for your original birth certificate.

I recieved exactly same RFE today.

It said Submit a copy of the applicant's birth certificate

I already included my birth certificate made in Japanese counsel

But, I did not submit original language one.

So I am going to submit both with English translation.

Jenn, did you recieve specific envlove with your RFE letter? I did not.

But, according to the USCIS web site

"NOTE: IT IS EXTREMELY IMPORTANT THAT THE LETTER REQUESTING EVIDENCE BE RETURNED WITH THE EVIDENCE AND THAT THE SPECIAL MAILING ENVELOPE PROVIDED BE USED. FAILURE TO DO SO WILL DELAY PROCESSING OF THE CASE AND MAY RESULT IN A DENIAL DUE TO ABANDONMENT. "

Thank you guys SO much for your replies! I just can't imagine my process without you!

I just got back from the post office and of course I sent the envelope overnight. I sent a cover letter with table of contents. The table of contents was like this:

1) Request for Additional Evidence (I-485) letter;

2) Copy of Birth Certificate in foreign language (Portuguese);

3) Copy of Birth Certificate translated to English by a certified translator from Brazil;

4) Copy of Birth Certificate translated to English by a certfied translator from the United States of America;

5) Copy of U.S. Citizen's (husband) Birth Certificate

That's it. I decided to send my husband's also just in case. I hope it doesn't take a long time for them to work on our case again.

Many people here translate their own document with no problem. We did the BC's ourselves. There is not need for any type of certification or notarization.
