Hello,

I am married to a Brasillian woman and currently living in Brazil. I am suppose to travel back to the USA for business on Sunday for three weeks. Before we married she owned her own home and we presently live in this house now. She's now telling me she going to change the locks and lock me out upon my return in three weeks. What does the law state about this in Brazil? Does she have the legal authourity to put me on the street or does only a Brasillian judge make decisions on these matters. We are married under Comunhao Parcial de Bens. I very worried about my return and if I will have a place to stay or if I am going to be on the street. I sold out and moved to Brazil and don't have another place to stay. I thinking about cancelling my trip due to my concerns about this matter because, I believe she just might do this. Could someone that has some information on Brazillian family law help with information. Thank you,

I take it you two don't get along then? I am sorry I have no law advice to offer but you should read up for yourself..I certainly would if my husband was throwing me out.....the best of luck.

I've never known a person that is intent on throwing a spouse out of the marital home, needing for the spouse to leave the counry first. She could change the locks when you are out of the house, temporarily, such as running an errand or at the grocery store, if she really wants to.

Not well versed in this area but Brazalian law does require you be seperated one year before a divorce can be filed so it seems unlikely you will get any help from the courts.

I think you are far better off here (I'm assuming your a USC) going back would probably be a bad move from the limited information you have given as you dont seem to have any other ties or resources there.

Good grief we have enough problems keepingup with USCIS marriage laws, not foreign domestic housing and marriage laws maype owners and mods can develop a whole new website make money and yada for foreign drama etc..issues such as this. WOW be the man and quit selling out and maybe she respect you a little.

august 2004 I-129 filed (neb)

DEC 2004 Approved

interview: SEOUL

MArch 21st , 2005AR for special security clearance,washington

May 18th tranfer case from Seoul to Islammabad

June 21st security clearance done

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.
