Cancellation of Visa Application: Can we apply a new one immediately after the cancellation?

Can we apply immediately?

Yes

No, "applying for a visa" is something you do after a petition is approved and you receive an invitation to do so from a Consulate abroad. If you withdraw a petition, you may file another immediately but they'll still have a record of the filing you withdrew. Why do you want to withdraw the petition and file another? The answer will have a lot to do with whether doing so will be successful.

They did not meet in the prior two years before the initial petition.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Then of course, no problem. Withdraw the petition and file another immediately. I suppose you could even put the withdrawal letter in the new petition package.

Facts are cheap...knowing how to use them is precious...

Does it really take 2mos before they give us reply?

Yes, about two months. Been there, done that.

Just curious about whether or not you gave an explanation as to why you had not seen eachother in the two years prior to filing the petition in number 18.

Question 18 reads:

Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was

established. If you met your fiancé(e) or spouse though an international marriage broker, please explain those circumstances in

Question 19 below. Explain also in detail any reasons you may have for requesting that the requirement that you and your

fiancé(e) must have met should not apply to you.

Just curious if USCIS ever takes this explanation into consideration...
