Before we got Married, I chose a lawyer to handle our K3 visa. I didn't know about this site at that time and I have to say, the info here makes the process a lot less daunting. Anyway, our lawyer tells us we do not need to have any proof of a bonafied marriage when filing the I-130, even though it plainly states that we do. Has anyone filed without the proof of marriage documents and gotten approved?

NOA1 : 3rd February 2009

I-130 APPROVED : 25th March 2009 [56 Days]

NVC STAGE

Case transfered to NVC : 06th April 2009

CASE COMPLETE : 04th June 2009 [22 Days]

Email with Interview date : 09th June 2009

Medical : 30th June 2009...Passed

28th July 2009 : "Visa is Approved"....Thanks to God and VJ!!!

This is why you hired a lawyer, to read carefully, interpret literally and respond accurately. He's right. Read the I-130 instructions again, carefully, then use a dictionary to look up and compare the definitions of "required" and "should". Pay close attention to the phrase "in addition to the required", then think about whether anything that is mentioned later is "required".

Facts are cheap...knowing how to use them is precious...

We didn't send any proof of a bonafied marriage when we filed the I-130 and I-129F forms.. Our both petitions were approved! You will need proofs when you go to your interview... It is a long wait to get the approvals of the petitions from USCIS.. It took us 9 months to get the approvals.. It may take less for you..but approx from 6 to 9 months.. I wish you the best of luck!

I'm a K3 too and my lawyer said exactly the same thing. I'm still waitting for my approval. She said i just need to take the proof of a bona fide marriage at the interview. I think you can relax and...wait. It's not a easy time. But we are goig to get there!!!

When I filed my I-130 and I-129f, I only submitted marriage certificate as proof. I just got approved this week without any RFE. you will be fine as long as you send them marriage certificate.
