Upgrading US citizens spouse I-130 application

Hi All

My husband became a US citizen on dec 5th 2008 and he received a letter to call and upgrade my I-130 application which he did the same day.

However after reading lots on the USCIS website and on VIsa journey I was aware that the US citizen spouse must mail a copy of his/her naturalisation certificate along with the case number and applicants name.

Please let me know if this is correct and what and how long will the next stages take?

Application Upgraded - Dec 05 2008

Touched- Dec 23 2008

Case approved at USCIS - July 20th 2009

NVC assigned case number- July 28th 2009...yeah!!

DS3032 mailed to us by NVC - Aug 3rd 2009

DS3032 emailed to NVC - Aug 5th 2009

AOS fee paid - Aug 5th 2009

AOS fee accepted - Aug 8th 2009-yeah!!

Email frm NVC to send I864 - Aug 19th 2009

I864 sent - Aug 20th 2009

I864 received by NVC - Aug 24th 2009

DS3032 accepted - Aug 24th 2009 Yeah email from NVC DS3032 processed:)

IV bill paid - Aug 25th 2009

DS230 sent to NVC - Sep 2nd 2009

DS230 received by NVC - Sep 4th 2009

I864 & DS230 processed by NVC - still waiting:(god willing it should be soon:)

RFE on DS230 - Sep 17th 2009 - NVC requires original Birth and Marriage certificate:(

Original certificates sent - Sep 19th 2009

NVC received docs - Sep 22nd 2009 - still waiting for some good news....

CASE COMPLETE - OCT 5th 2009 - YEAH...NOW AM WAITING FOR AN INTERVIEW DATE..GOD WILLING THAT WILL B NEXT MONTH:)

INTERVIEW email - Oct 13th 2009

INTERVIEW DATE - NOV 20TH 2009....YEAH...YIPPY...AM SUPER EXCITED!!

Yeah interview over just have to submit one document tht was missing then i will get my visa!!nov 22nd 2009

Call the number in my signature, they will notify the office having jurisdiction over the case that your husband has become a U.S. citizen. At this point the office will request a copy of the naturalization certificate. Its as simple as that. Sometimes they won't even need a copy of the certificate. Some offices can just check the computer to confirm he was naturalized. ;)

Note: A certificate of citizenship/naturalization contains a warning indicating it cannot be copied. However, for the purpose of an immigration benefit, it is acceptable to make a copy of the certificate of citizenship/naturalization.

I just work Tier I (civilian) customer service for USCIS and have been in many types of scenarios over the years. I am filled with Immigration knowledge.

thank u.He has called and notified them also is sending a copy of his naturalisation certificate today.Aftr that wht is the next step / stage?how long will it generally take for this type of a visa that is an IR-1?Its a long long wait and I hope to join my husband asap:)

Filed: Timeline

It depends on when the I-130 petition was filed. It would be the receipt date on the first Notice of Action (I-797(x)) and/or the Priority Date for the I-130. Then you check the processing times for the office processing the I-130. I can check them to estimate the next steps you will need to take (if any) at this point. I just need two things...

1. Priority Date/Receipt Date for I-130

2. Office Processing the Case (This is the return address from I-797s, this will be either California or Vermont)

hey my I-130 was filled in mar 2007 when my husband was an LPR.He upgraded it in dec 2008 when he became a citizen. Vermont service centre is where my application was filled.

Checked the processing dates for VSC it says feb 2008 for I-130 fpr US spouse.

What do u say?
