My husband and I will be divorced and I have decided to just return back home to Canada when my greencard expires. How many days do I have left here in the U.S with my expired card before I get barred or something? And will there be any sort of effect in my travels in the future to the U.S? And should I notify immigrations that everything should just be cancelled as I will be returning home? k

I have no words of advice. I just wanted to say how sorry I am for your situation.

You should leave prior to your green card expiring, to avoid any issues in the future. As long as you stayed in status of your visa/green card, you should have no issues.

I would notify immigration about your status - even just for peace of mind.

Sorry to hear about your divorce though, take care!

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So sorry for your situation... I'm going through a very similar thing... I already returned to my country, actually. What I'm thinking is going back to the US before being banned (I think it's 8 months) and once I'm there, to file for a re-entry permission, which allows to stay out of the country for longer.

Otherwise, and I'm seriously considering it, I would just redeem my GC. I just would like to be able to get a tourist visa instead so I can go to visit my friends and stuff... but I'm not interested in living there anymore.

It seems there is an official procedure for surrendering the green card by using an I-407 form but it is not longer available at the USCIS website and all references I find for it are more than two years old. I wouldn't risk it but a 180 day overstay is when you face a ban. Any overstay can cause you future problems at the border.

Facts are cheap...knowing how to use them is precious...

I think she could just go to her local consulate and surrender it there and probably ask for a visitors visa at the same time

- that is weird USCIS doesn't have anything on this.. :blink:
