This may sound stupid... but for the DS 230 they ask all the places you lived for more than 6 months. The embassy told me it ment all the places you lived/travelled/studied for 6 months or more. Now.. for the police clearance, that does not also mean that you need one for all those places too? It does say all the places you lived.

My husband travelled thru japan for 1 and 1/2 years.. He wouldnt need a police clearance would be from there, right??? That would be ridiculous if you would need one from a place you just travelled through. How would the police even have anything about you?

Im so confused!!!!!!!!!!!!!!!

I needed on from Japan - I lived there for 2 years. Good news is that it's free at Japanese consulates. Bad news, you have to go to the Japanese consulate to be fingerprinted - and be prepared to wait at least 2 months for the clearance to come back!

AOS

August 30, 2005 - AOS, , AP applications mailed to Chicago Lockbox

September 9, 2005 - NOA's for AOS, AP, (dated Sept. 1)

November 28, 2005 - AOS biometrics - refused EAD biometrics at the same time

December 5, 2005 - AP approved

December 7, 2005 - Infopass appointment for interim EAD

December 12, 2005 - Received EAD card

December 13, 2005 - Received AP

June 14, 2005 - Case Status Inquiry/Tracer

June 19, 2005 - Letter sent to congressman

AOS INTERVIEW SCHEDULED FOR AUGUST 8, 2006

AOS approved - August 8th, 2006 - hooray - done with USCIS for now!

GREENCARD RECEIVED - August 18, 2006

Can I request police clearance here in the states for my fiancee since she was here for 1 year ,or she needs to go to USA Embassy in her country and ask for it ?? What is better and do we have options with this ??

12/12/05= I129F received by USCIS /Vermont SC

12/15/05= I received NOA1 by snail mail

02/10/06= Petition Touched ,finally something from USCIS

02/10/06= @ 5:00 PM ,just received e-mail from USCIS finally APPROVED ,

02/17/06= Received snail mail from VSC my petition approved

02/17/06= NVC Received

02/17/06= NVC Left

02/20/06= Consulate Received

03/06/06= US Embassy told her she can come 3/7/2006 for interview

03/07/06= Interview Date : VISA GRANTED & Will pick up VISA today

03/15/06= US Entry

05/11/06= Wedding

AOS/EAD

09/01/06= AOS/EAD mailed in to Chicago

09/05/06= USPS confirms delivery

09/12/06= NOA1 AOS & EAD arrives in mail

09/18/06= Received Biometrics appoint. letter

09/22/06= Biometrics appoint.

09/29/06= Received RFE in the mail..(BC not translated,even we had international (with English Vers.) BC

You don't need police clearances for the US since that was done when you petitioned for your fiancee.

Are you telling me that they do not require police clearence for USA ,but they do require it for for/from other countries if that person lived there ??

Yes. USCIS and DOS do police clearances on petitioners and beneficiaries before they issue visas.

I guess I dont understand.. I dont see how they would even know anything about him if he was just travelling. And then.. he was in Malawi in africa for 9 months.. so that means he needs to try to get something from africa?? Wow.. if anyone has ever been there, they know the pace of things getting done is ridiculous!!

So basically he has to get them, there is no option?

If the beneficiary lived in a country for more than six months after the age fo 16 (I think) then they will need to provide a police clearance from the country to the consulate officer. Good luck

If they don't know anything about him, then there will be no record. But that does not excuse the fact that the police certificate is required. The instructions are clear, if an individual resided in a foreign country for longer than 6 months, then a police certificate from that country is required.

Amy. You need to answer this question: Did your fiance reside in Japan(live there) or did he reside elsewhere and just "travel through" as in visit for short term business, etc.?

Was his trips less than 6 months in duration as in multiple trips over a six month period, always returning to his place of origin? If so, then no police clearance is necessary from Japan. If he lived there for 6 months or more, then yes you need one.

Additionally, there's a list of Countries that do not provide Police Clearances to people currently outside the of their country.

Perhaps someone can refer you to the list. I cannot find it at the moment.

If you're lucky perhaps you won't need one from Japan or Africa.

A Police Cetrtificate is avialable from Japan. It is free of charge and is available from the consulate.

And for Malawi

POLICE RECORD

Available. Centralized criminal records covering Malawi are maintained at the Criminal Investigation Department, Police Headquarters, Private Bag 305, Capital City, Lilongwe 3. The Malawi police issues certificates upon application and submission of declaration (see Special Clearance Procedures) and fingerprint charts (2 copies) indicating whether a criminal record should exist or not, and if so, particulars of the offenses, nature of punishment and/or period of imprisonment. Please also include dates applicant was in Malawi as well as the address of the applicant in Malawi. There may be a fee for this service.
