K1 visa versus K3 visa

I know that this question has been asked before but I just heard something today that makes me question the past knowledge that I had in reference to the K1 and the K3 visa.

I have heard that it now takes about the same amount of time to process either the K1 or the K3 visa, is this true? There's suppose to be a ruling from December 2005 that the K1 and the K3 visa gets processed in the same time frame, is this true?

I applied for the K1 Fiancee visa through the Nebraska USCIS, if I had known that the time interval would be the same for either visa I would have married Xiang when I was in China and applied for K3 status.

2006-04-25 Date packet was sent from NVC to Guangzhou, China

2006-07-07 Date Xiang recieved Packet #3 from Guangzhou, China

2006-07-08 Date Xiang sent Packet #3 to the U.S. Consulate

2006-07-27 Date Xiang recieved request for biographical information on our daughter

2006-07-27 Date Xiang sent biographical information to the U.S. Consulate

2006-08-17 Date Xiang sent biographical information to the U.S. Consulate, again!

2006-08-21 Date Xiang called, faxed and mailed the U.S. Consulate the biographical information

2006-08-22 Email from the U.S. Consulate, they FINALLY received the G-325A form for our daughter!

2006-08-22 Waiting patiently for Packet #4 to arrive, bring my soulmate to my open arms!!!

2006-08-25 Packet #4 sent out from the U.S. Consulate, in transit to my baby!!!

2006-08-29 11:25pm Email from the U.S. Consulate, the interview date is October 17th!

2006-09-29 Medical examination for Xiang and our daughter Qi. Interview is just around the corner!

2006-10-16 11:15pm VISA APPROVED!!!!

2006-10-29 Xiang and Qi arrived in Detroit, immigrations 2 1/2 hours, finally holding my sweetheart in my arms.

2006-11-05 Exchanging our vows, what a beautiful day for our wedding!

I don't know if it takes the same amount of time to process K1 and K3, and I've never heard of that ruling. K1 used to be faster, I think, but with IMBRA, no one knows how things will play out in the next few months.

It truly is hard to figure out which visa will go faster. I mean, when my husband and I started our visa journey, we planned on just applying for the CR-1 because at that time, the CR-1 was going faster than the K-3 (previously, it was the other way around). But then, a few months later, we noticed that K-3 picked up speed and so we sent in our I-129F. Our I-130 was approved 2 months before our I-129F, and yet, our K-3 got an interview first. :huh:

I noticed your I-129F is already approved. In my opinion, I think you should just go on with it because cancelling it and then applying for a different type of visa might give you problems (the USCIS might get confused :unsure: ).

07/07/2006 Case forwarded to Consulate in Montreal (Day 293)

08/11/2006 INTERVIEW! VISA APPROVED!

08/14/2006 Picked up visa and crossed the border.

08/25/2006 SS card arrives in the mail

09/07/2006 GC arrives in the mail.

K-3

02/01/2006 Mailed I-129F

02/07/2006 NOA1

04/14/2006 I-129F is approved!

04/24/2006 NVC forwards the application to the consulate in Montreal

05/01/2006 Packet 3 is received from consulate & is sent of 3 days later

08/08/2006 INTERVIEW- cancelled bec. of CR-1

IMBRA has certainly muddied the water at this point. I can tell you what I have been told by others. I have heard that the process for K3 can often be more difficult. From what I understand there tends to be more scrutiny of the relationship. You might try comparing the historical data here on VJ to see how K1 times compare to K3.
