noa1 on 5-12-08 and still no responce.

Hi everyone . I recieved the noa1 for my fiance's visa on 5-12-08 and have been waiting and waiting and seeing everyone else geting approved , most people approved who filed after me . I have not goten an RFE which is great , but i just dont understand why everyone else is getting approved before me . My case is at Cali.Svc. center , i hired an attorney to help me with submiting all the papers so i know it was done right , my case is very simple both me and my fiance have never been married . i have called the USNIS ofice twice , but still nothing. i miss my Fiance and im worried when we are finnally gonna be together again. has anyone else waited this long for a responce ? should i just keep waiting? thankyou.

You have passed your 6months that it normally takes for a visa to be approved the best bet is to start calling USCIS and looking for some answers, make sure you talk to a supervisor, someone on the ground floor is just going to tell you that "we are processing March and your well within the processing times".

Failing that you can write a letter to your congressman (sentor? I forget what they are called in the US) stating your situation and see if you can get him on side, for some it works for others it doesn't.

Other then that there isnt a whole lot you can do when USCIS slows down. They normally have a convient pile of excuses as too why they are taking so long. There are plenty of people on VJ who have waited over 6 months, and a few who have waited over a year, and some those are still waiting.

11-10-2008 RFE returned

03-01-2009 Confirmed Case lost by USCIS

04-03-2009 Refiled K1 Visa application complete with expedite due to USCIS error.

05-14-2009 K1 package once again has vanished....

06-08-2009 Hired lawyer to proceed with Appeal process.

06-26-2009 Paperwork Fedex'ed to lawyer

07-02-2009 Lawyer submitted our suit to court

07-17-2009 Court day 2: Success, must respond by 21st August. - No result ever came from this.

10/06/2009 Withdrew K1 petition

10/10/2009 Married

10/24/2009 CR1 packet completed and posted

10/26/2009 Packet arrived at Chicago - And Submitted our Aussie application

11/04/2009 Application of CR1 returned - was rejected because of a "blurry zip code" we didn't bother to re-apply given that Chris had lost his job

04/05/2010 Australian application still pending

September 2010 - Chris arrived in Australia on Temporary Visa.

10/10/2011 - 2 year wedding anniversary - Chris to be granted Australian Permanent Residency

Summer 2012 - Planned immigration to USA.

*We have visited each other 8 times since 2007*

You are VERY patient! Call the service center every day, even when they tell you not to call for a few weeks. Try to get to the actual service center and not the call center which only has pre-packaged put-off answers. Also, contact your US Senator or Congresssman (hopefully incumbent) and ask for their assistance. Experienced Senators and Congressmen have departments set up just to assist in Immigration cases. Once they file a Congressioanl Inquiry USCIS will find your file wherever they have lost it and get it moving quickly.

March 13, 2008 Called CSC was told that file had been given to AO on Mar 13th and should be approved probably within 10 days

April 7, 2008 Called CSC Was told file had not been removed from file room and he would walk over and get it to an AO since they had been working on those vintage files for a while. TOUCHED

April 8, 2008 TOUCHED

April 14 Contacted Senator McCain's office for assistance

April 14 Called CSC, was told the file had been sent to FBI for security check and this could take weeks or months. TOUCHED

April 17, applied for B1-B2 appointment date - only 3 weeks away.

April 17 TOUCHED

April 18 TOUCHED, EMBRACED AND KISSED. Notified by email and on site that 129F was approved, 160 days

APril 23 TOUCHED AGAIN? Hopefully the touch is just the CSC boot kicking our butt out the door

May 2 Left NVC

May 5 Received US Embassy, Manila

May 11 B1/B2 interview- approved

May 15- June 21 She came to visit in US

June 22 returned to PI

June 23 K1 Interview, doc verification not complete (VERIFY THIS ACTUALLY HAPPENS!)

Cancelled flight plans for her first 4th of July in US

July 3 Approved document verification back to Embassy

July 11 VISA ready, picked up at Embassy

July 12 Flew to US and entered K1 at Miinneapolis - painless.

July 29 Married in US

October 8 Paperwork for AOS and submitted

Nov 13 - Biometrics

Patiently waiting for AOS, EAD and AP - easy to be patient while happily being married and living together!
