Hello,

I applied for K1 for my fiance in India. it was denied last month. now i want to marry her and apply for K3 visa. can we apply within 2 years after K1 denial? Reason they denied the K1 because we didn't meet in person and we did not sign the application :crying: , I heard their is a family unity wavier, are we eligible for it? And if we can Apply for K3 then should we have to apply I-130 from India or USA? Please reply soon. thank you

interview date- 11/06/2009

visa approved! 11/17/2009.. pheww!!

received passport-11/20/2009

entered in US- 12/14/2009

POE- New york

welcome received- 02/01/2010

green card received- 02/08/2010

removal of condition-12/15/2011

ROC package sent to CSC- 09/21/2011

You can probably get a waiver for a K3 but if you just file the I-130 and go the CR1 visa route, there would be no need for any waiver because you would file no I-129F.

Facts are cheap...knowing how to use them is precious...

Filing an I-130 would result in a CR1 visa. It's a petition, not an application and can only be filed by a spouse, not a fiance. The guides will spell out the process for you nicely. Just click on the word "Guides" at the top of any page here.
