Applying for K3 within 2years after denial of K1?

Hello,

I applied for K1 for my fiance in India. it was denied last month. now i want to marry her and apply for K3 visa. can we apply within 2 years after K1 denial? Reason they denied the K1 because we didn't meet in person and we did not sign the application , I heard their is a family unity wavier, are we eligible for it? And if we can Apply for K3 then should we have to apply I-130 from India or USA? Please reply soon. thank you

You can probably get a waiver for a K3 but if you just file the I-130 and go the CR1 visa route, there would be no need for any waiver because you would file no I-129F.
