Hi,

I've seen some people here that are doing /have done AOS from B1/B2 got married after entering the USA. Is there anyone here who got married before entering the USA, then doing an AOS after they arrived? Just wondering..

04/20/2004 Got married in the Philippines, and lived between here and there

10/15/2008 Husband arrives in USA on B1/B2 Tourist Visa

12/19/2008 Sent I-130 & I-485 AOS package via USPS Priority

12/21/2008 Package delivered

12/26/2008 NOA's dated for I-1485, I-130, I-131, I-765

03/30/2009 Obtained Green Card

01/24/2012 Mailed in N-400 for Naturalization

01/31/2012 Check for $680 was cashed

It does not matter if you were married before or after your entry to the US. What does matter is your intent at entry, If you entered with the intent to remain and file for AOS then you are committing visa fraud and you may have major issues, if on the other hand you entered with no intent to remain but changed your mind after you arrived then you can file for AOS and should have no major issues adjusting your status.

It is always wise in your circumstances to seek guidance from an immigration lawyer to ensure you have no issues that would cause you problems down the road.

I am in this situation. I have the interview on February and my fear is that I can be accused of visa fraud.

Iulia I wouldnt worry about it and I bet you will get approved. As long as you have a bonafide marriage and your intentions at the time wasnt to get married and immigrate then all is well. It is only visa fraud if your intentions at the port of entry was to marry and immigrate. I came here as a vistor also and did AOS and my interview is coming up, so you'll be fine. Good luck to you.

I adjusted from a vistor visa and all is well, take a look at my timeline. As long as you had no intentions to marry and immigrate you should be fine to file for AOS. I would advise you to see an immigration attorney though. Good luck to you on your process and welcome to VJ. Dont be afraid to ask questions here.

Dear wackodacko and Iulia,

I am new to these forums and would like to share my complication.

I am in the same situation as well. I am a U.S. Citizen but my wife entered the country on B1/B2 visa while we were already married for about two and a half years. We never meant to stay in this country and wanted to move back to our home country. Not sure how interviewing officer will view it, but I am hoping for the best. Our answer to her intent while entering USA would be

1- She just wanted to see around and visit U.S.A before we finally settle back in our home country

2- She did not apply for a visitor visa for about two and half year after our marriage (Point here being: why would one wait for two and half year, if one really wanted to misrepresent/fraud to get visitor visa with intention to permanently settle in U.S.)

3- She wanted to experience the culture and community here in U.S.

4- She even got her visitor visa extended to experience a few religious celebrations here (point here being: why would one extend his/her visa if he/she never intended to go back in the first place)

I am hoping that all these would be able to convince the officer of her intent to go back when she initially entered the country.

Suggestions/feedback.

Its not really what you say but what you prove. Such as a letter from the foriegn employer stating that he/she was supposed to go back to work, a lease agreement/mortgage, utility bills, etc.

I-immigrate—there ARE quite a few people floating around VJ who have adjusted this way. This subforum is relatively new (like, less than 6 months I think), so there are probably not that many people who have already finished their process who check it regularly.

When I was adjusting this time last year and we didn't have this "Adjusting from Work, Tourist, Student Visa etc forum", I kind of looked around at tons of other people's signatures and time lines to see if I could find people in a similar situation, and then I pm'd them to ask their advice. You might have to do that too. I know I have seen people asking about this, I just can't remember their names off the top of my head. It is SO reassuring when you find others in the same situation as you, so I'd do a few forum searches in there and in the regular AOS forum with some relevant keywords and see if you can find anyone that way, who just isn't necessarily checking these forums anymore.

You have probably already done this:) Just an idea!

Concurrent I-130 and AOS

Nov 30 2007 - I enter US as a tourist to spend the ski season with my sweetie and figure out what we both want outta life - we plan on ending up in Canada, but...

Jan 30 2008 - We get married in Vegas! We decide to stay in the US.

Feb 08 2008 - File I-130, I-485, AP and EAD

Feb 11 2008 - Package arrives in Chicago

Feb 19 2008 - Receive NOA 1 for everything except I-485. NOA date Feb 15th

Feb 19 2008 - Touch I-130, AP, EAD

Feb 21 2008 - Receive I-485 NOA 1. NOA Date Feb 15th

Feb 22 2008 - Receive Biometrics notice, dated Feb 20th, for appointment March 11th

Feb 27 2008 - Walk in to Denver field office and have Biometrics taken early as the 11th March I'll be away

Apr 16 2008 - EAD card production ordered

Apr 16 2008 - AP approval sent

Apr 21 2008 - AP received in mail

Apr 21 2008 - EAD card production email received again - strange

Apr 24 2008 - EAD card approval notice sent email

Apr 26 2008 - EAD card received

May 03 2008 - Interview notice received -June 27th

May 22 2008 - Touch on I-485

June 09 2008 - I-130 finally shows up online and shows a touch that day, so does I-485

Jun 27 2008 - Interview - approved, stamped, received card production email. Ya-hoo!!!!

MOVED TO SAN DIEGO!!

June 11 2010 - Package mailed

June 16 2010 - NOA date

July 2 2010 - Bio letter received - July 27th date

July 9 2010 - Early biometrics walk in San Marcos CA

Sept 16 2010 - Card production ordered

Thanks for the input bluegreen. I have been trying to search for folks who were in same situation as I am in currently. I found a lot of couples who were able to adjust their statuses successfully, but they married AFTER they came into this country and one of the spouses was on tourist/visitor visa.

I still have yet to find a couple who successfully completed their adjustment journey when:

1- The couple was already married PRIOR to entering USA

AND

2- One of them entered USA using a tourist/visitor visa

Any referrals, contacts of such people will be appreciated or any forum links with such cases will be great.

Hi Everyone

I'm new to this site I just joined today. I was wondering if anyone could help me. I recently got married to my Husband on Dec 27 2008. He is a U.S. Citizen and lives in Louisiana. I'm from Belize C.A. and I after we got married in Belize I decided to come up to live with him on my visitors Visa. I arrived in the U.S. on the 10 of Jan 2009, and they gave me 6 months on my I 94 so I was planning on staying until July 9th 2009. We want to start our paper work but after logging on to this website I read it is illegal to file for you papers while already married and in the U.S. I'm I right? do I need to go back to Belize and start the process from there? Whats this change of status I'm reading about? Can I do that first? Is there anyone here that was in my situation. Please help thank you I would really appreciate it. Oh do you think I should get a lawyer? Thanks once again

You are right. You can not start the process from here, it will be illegal, since you decided to live with him here then came. If you get caught doing that, you can be banned for a certain amount of time from entering. Your husband is going to have to file for a K3 or CR1 visa for you. He can apply for you right away while you are visiting, but you need to go back home by the time your I94 expires, for the interview at your consulate/embassy.

Thanks for replying! It's great to know that I'm able to stay until my I 94 is up. I plan on returning a bit before though, probably in June just to be on the safe side. But I'm guessing that I won't be able to return to the U.S. until after my interview. I'm thinking about talking to the Embassy in Belize and asking them if i can still travel back and forth while waiting for the interview date. I would never over stay my time because I know it would make the process more difficult.
