Hi everyone

Hope someone can help me (and my friend) out!

Basically my friend (British) has met the man of her dreams (American). Now that she has graduated from University she wishes to go to the USA under the visa waiver program and stay with him for the maximum 90 days, before returning home. Then approximately 6 weeks later she intends to go back in again on the visa waiver program and stay for the maximum 90 days before returning home once again.

Is there any issue with repeatedly entering under the visa waiver program for the maximum period? I've tried researching this myself but to no avail!

I would be very careful, that is what I would tell your friend. I being the USC, did that coming to the UK. I came here last May, was suppose to stay until August, then ended up staying past that. My 6 months was up last November (6 months is what the USC is allotted when you come to the UK), and we ended up going to Spain for a week then coming back. I was told by customs that they would give me another stamp and let me go through, but if I did it again without a visa (other than the vwp), then they more than likely won't let me through again. I had to come back to NY to get my visitor for marriage visa back in March so I am good until Sept.

I am not saying that your friend won't get through, but I am not saying she will either. It is a risk no matter what. Is there a way where she can apply for a visa that would allow her to work or anything?

well it would all be up to the person you deal with at your point of entry.

I would personally say its probably not likely that they could go back so soon after leaving. I was in the US in march for 2 weeks and im heading back again at the end of june for 2 weeks and im a bit cautious of the questioning i will get.

the very basics, she would need a return ticket and many advise as much evidence to ties back home. ie job and lease/mortgage but even then, its the one person you face at the airport who decides.

If she isnt allowed entry, she wont ever be able to use the waiver program again.

Your friend doesn't want to make it look as if she is using the VWP to essentially live in the US. That will make it very easy for an officer at POE to turn her away - which isn't a risk worth taking IMHO (esp. if they eventually want to petition for a fiancee or spousal visa).

They may well question why she is returning so soon and if she cant show strong ties to the UK... is lease on a apartment, letter from employer stating she has to return by a set date... she may well get denied entry...

The VWP was intended to be used as a way to get round having a visa... it was intended for tourists to allow them easy entry for short vacations....

The first 3 months should be a breeze, but after that it could be a challenge getting back in as m_molask said its going to pretty much depend on the poe officer....My fiancee was denied on the vwp from the UK...and once he was denied was told only way to ever return to the states is with a visa the vwp is done and hes not been back i have to make all the trips to the UK till we get the K-1

Even with the the so called "Strong Ties" it can be a challenge

If the CBP believes that she's spending more time in the US than in her home country, they won't think twice to send her packing. The rule of thumb is to spend at least as much time in your home country as in the US. If she stays in the US for 90 days, she should plan to stay in the UK for at least that if not more...

It definitely can be done but if you decide to do so, be very careful. Make sure you carry LOTS of evidence of ties to the UK and a return ticket back to the UK dated for a couple of weeks later. You can change this ticket later for a fee if you change your plans re: how long to stay...

April A friend told me that she thought my ideal man lived in Wyoming or Montana.

May 17 Did search on match.com. Found no-one in Wyoming. Only wrote to one person in Montana...his name was John. He replied two hours later.

Jun 26 Flew to Missoula to meet him & a weekend trip turned into a five week visit...

Many trips between US, Canada & Europe.

2005

March 31 During a meeting in Vancouver, John proposed & I said YES!!!

Jun 2 Finally sent off our I-129F & a few days later we received NOA1. I am now officially an alien bride-to-be.

Aug 22 Email notification of NOA2.

Sep 12 Received letter to say application would be forwarded to US Embassy.

Nov 23 Returned packet 3 to Embassy

Nov 30 Medical

Jan 5 Got interview date

Feb 1 Interview. APPROVED!

Feb 2 Visa delivered.

Feb 7 Flight to Seattle.

Feb 8 Finally back home in Missoula, MT. I'm happy, John's happy & the cats are ecstatic - together again!

There's an issue with using the VWP to effectively live in the USA interrupted by brief visits back to the home country, the issue being that that's not what the VWP is for.

Your friend may get away with the 2nd VWP visit, but she is very unlikely to get a 3rd visit following the same pattern.

Returning home at the end of one's visit is an important issue, but it is not the only important issue as your post seems to imply.

A zyggy points out, one doesn't just have to leave the USA, they have to stay out for a while. One cannot use the VWP, or a B2 visa, to live in the USA without immigrating.

I know that you can not abuse the vwp-I just wanted to stress to anyone coming back(after being here) on the vwp-that you will need to be prepared to show evidence of your departure. I would certainly never recommend using the vwp too often-you are asking for trouble :yes:
