quick question on I-1864..part 3 of the form ,do i have to write my 2 kids name in #9?..... by the way im filling for my AOS first and maybe my kids later this year...thanks...

First, the form is I-864. :lol: And no, you won't include the kids if they are adjusting (coming to the US) at a later time. I know it says "within 6 months" but I would only put the people who are adjusting now. I'm in a similar situation. My fiancee came in May, and we got her greencard and her kids came in December, exactly 6 months and 2 weeks later. We will send the forms to adjust their status sometime this month.

Depends on what "later on" means... and then only you can answer that....

I had the same questions about 6 months ago, and I was advised (by VJ'ers) that only the people that are adjusting NOW should be put on that form, not anybody who is adjusting later on whether it's 6 months or 6 weeks later.

Wait... the kids are here with you? Why are you filing separately? From your first post, I understood it to say that they will be coming to the US at a later time. If they are here, you should just file together.

How old are the kids? If they are under 14, and you file them at the same time, their fee is only $600 each. If you file separately, they are $930 each. If they are older than 14, they are $1010 whether you file together or separately.

K-3 visa holders need to include a copy of the approval notice (NOA2) for I-130, so then I imagine that when adjusting K-4 visa holders you would send a copy of your I-130 approval notice since they were listed on your I-130.

Tip: Include separate checks for each person's fee because each application must have its own payment attached to it. If you include one check for all applications, it will be returned to you saying "please attach correct payment"

YES, they need an I-130 for each child. Alien number will be "NONE" for the K-4 as one has not been assigned yet.

16Q: How does a K-4 child adjust status in the United States?

A: The K-4 child will not be able to file for adjustment of status in the United States until the U.S. citizen parent/step-parent files a I-130 on behalf of the child

You mean I need to file I-130 for each of them together with the AOS forms? so if i file for my eldest, i will send separate check for AOS and I-130 ($1010 and $350) and for my youngest $600 and $350, am I correct?

Now im trying to fill the form I-130 for them, if im right my husband will be the petitioner? thanks again!
