Timeline

Hi!! Finally my EAD has been approved!!! However I am going to Costa Rica for a month with my hubby. We leave in 2 days. What will happen if I do not have me EAD when re entering? I do no think it will arrive in 2 days... will this be an issue??

Please any advice will be appreciated!!

EAD for working it is NOT for re-entry from travel out of the country, you need AP, Green-card, or a visa that allows travel while AOS is pending like a K-3.

A J-1 may alow re-entry from a trip abroad if it is still valid HOWEVER traveling without AP WILL terminate the AOS processing.

NOTE: If you are in the United States and wish to travel abroad, you do not need to apply for advance parole if both conditions described below in A and B are met:

A. You are in one of the following nonimmigrant categories:

1. An H-1, temporary worker, or H-4, spouse, or child of an H-1; or

2. An L-1, intracompany transferee, or L-2, spouse or child of an L-1; or

3. A K-3, spouse, or K-4, child of a U.S. citizen; or

4. A V-2, spouse, or V-3, child of a lawful permanent resident; and

B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your behalf and is pending with USCIS.

However, upon returning to the United States, you must present your valid H, L, K, or V nonimmigrant visa and continue to remain eligible for that status.

Did you file an I-131 for an AP doc?

The EAD has nothing to do with entering the country, it is just authorization to work. Does your J1 visa still allow you to travel?
They could travel if it is valid, but doing so without AP WILL be considered to be abandoning the AOS process.

Hi!! Sorry I thonk I wasn't clear. I got my AP document 2 weeks ago. I have that with me. However today I got an email saying my EAD has been approved. DO I need to show it to the inspector at the POE or is the AP all they need??

Then you may want to fill in the AP and EAD sections in your timeline, all it shows is AOS.

The AP is all they need. No need to show any EAD.

05/12/04 => Arrived in the US under L1 status / work visa

03/05/05 => Met the love of my life

07/02/07 => Married my wonderful USC husband

______AOS JOURNEY________________________________

10/03/08 => Package sent to USCIS

03/03/09 => Interview in Chicago, IL =>> APPROVED!

______REMOVAL OF CONDITIONS JOURNEY______________

12/03/10 => Package sent to California service center

03/02/11 => 10 YR GREEN CARD RECEIVED!!

______CITIZENSHIP JOURNEY_________________________

01/20/12 => Filed N-400 for Citizenship

06/21/12 => Citizenship interview: Approved!

07/25/12 => Oath Ceremony.. DONE WITH USCIS!!
