Hi All :) My husband and I had our AOS interview in November, it was approved very easily, and he received his conditional green card in the mail.

A few weeks ago we got a phone call that his father has been diagnosed with lung cancer and is going to need chemotherapy in the very near future. He is thinking about going to visit his dad during the time he gets chemo and I know that its no problem because you can be out of the country for a few months without incident at the border. My question is if he goes back to Canada for a month or two would he be able to work while he's there? Its just that he couldnt afford not to if he were to be gone for that long. He would still have his address and bank accounts, etc here so it wouldnt look like he was trying to move back or anything like that.

As a Canadian citizen, he should be able to work & pay taxes there.

But there arent any laws or restrictions that he is obligated to only work in the US? When he claims foreign taxes during the time he files his tax return here I just want to make sure it wont cause a problem. If its as easy as that then hey i'm not complaining, i'm just trying to make sure we dont do anything wrong.

He's not obligated to work only in the US - based on your description, it sounds like it will be 'as easy as that.' :thumbs:

The above posters are correct.

He will just have to report all his earnings to the Revenue of Canada

So sorry to hear about his loss :(

He will need to report his Canadian earnings to the Internal Revenue Service, but they will not be taxed.
