Spouse has been here on Student Visa and we are about to file I-130 along with I-485. My question is... do I also file an I-864 Affidavit of Support? I have read that it is reviewed during a change of status...should I send it along or wait for them to notify us?

Thanks for any advice!

Difficult to understand what you are filing for? Says wife is on a K3 but you should have already filed a I-130 if that's the case. Plus her being on a student visa really confusing?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

You are adjusting status from "Visitor work or student" visa NOT filing for a K-3 visa, moving this to the correct forum.

I-485 REQUIRES the I-864 to be attached, without it and the application will be rejected.

Since your spouse is already here, as ou know you'll be filing to adjust status- this requires the I-130, I-485 and the I-864 has to be sent in with this package, along with the accompanying G-325'S for both of you and the supporting documentation, such as the I-693- the medical form and proof of a bona fide marriage. All of that is considered initial evidence and have to be received in the initial package. Read the guides- very informative and welcome to visajourney!

N400 (Citizenship Application):

Package sent: 02/17/2012

NOA Date: 02/21/2012
