I'm sure this has been asked before, but I'm sorry I just dont have time to try and search for it so here goes...

What needs to be done in order to put your spoce on your taxes if they have not received their SS# yet?

~ 03/30/08 - Packet sent to VSC

~ 04/22/08 - NOA1 issued - Yeah they took it this time

~ 05/22/08 - Touch

~ 07/25/08 - Touch (showed about 1pm on the USCIS site)

~ 07/25/08 - NOA2 sent (must have been later in the day - noticed it on 7/26)

~ 09/10/08 - INTERVIEW - VISA APPROVED ! ! ! !

~ 09/12/08 - VISA RECEIVED

~ 10/17/08 - Arrival in the USA (JFK POE)

~ 10/31/08 - MARRIED! ! !

Well I'm not sure if this is the "correct" answer, but the same thing happened to me last year and this is what I did:

I filed initially with me as head of household (with my 3 children) and my spouse not on the tax form at all (I could be wrong, but I don't believe it is possible to list a spouse who doesn't have a SS#), then I later filed an ammended return once his SS# came. Our situation was pretty simple though, as he had no foreign income to disclose. The only thing that changed by me ammending the return was that we got an additional $400 back.

Like I said though, I'm not sure if that's the correct or best way to go about it...you probably want to check with your local tax professional for the best solution for your individual situation.

how long does a person have to file the "ammended" return and what is that??? sorry don't know much more then the basics on taxes

no time limits on filing amended returns - but if you wind up owing taxes be prepared for penalities and interest. if you cannot file by the years deadline then you should file an extention and follow-up.

I pulled up on the IRS site that if you have applied for a SS#, which we have then you can apply for a ITIN (income tax identification #). So basically if anyone else is in the same situation than you need to do what the other person did above.

Nice to know that you will possible get a little extra back once they get a SS#..

He didnt have any income and just got here in Oct so im sure I wont owe anything (havent in years) once we amend the return.

Our situation is that immigration spelled his last name wrong at his POE. Now SS wont issue a SS# until everything is straight.

2 info pass appointments and 4 trips to the SS office and still no number..... Got to love the G O V

Oh sheesh...yeah, isn't the govt. fun? Well it seems in your situation, filing an ammendment at a later date shouldn't cause any problems. Just look for form 1040X on the IRS website and send it in when you're ready. Or you could try to wait it out until the April tax deadline and see if your husband has his SS# by that time.

I will say that the 1040X is a really complicated form and it took me a while to figure it out and get it right. Filing for an ITIN# might be a less complicated option. I didn't know about that one.

sorry - missed the "got here in Oct" part! As long as he was in your household by Dec 31 - you can claim him. get the ITIN#.

With the ITIN number, you can file for a spouse not in the US.

So Rajaa, you may have been eligible to file married on your 2007 taxes as well - if you were married as of 12/31/07.
