hello everybody i found this site as very useful to any one who needs help about immigration matters, i came in US as k3 after spending time with my husband for 4 months we find out that we cant get along well and we get divorced my problem is he didnt apply and adjustment status for me and my visa will be 2 years early this year 2009. i am not living with him anymore. what should i do?

A K-3 becomes void 30 days after divorcing the initial petitioner. I am afraid you have no option but to return home.

A K3 visa holder who has not adjusted status must leave the USA within thirty days after the divorce is final, regardless of the expiration date on the visa.

You posted asking what you should do. The regulations state you must leave the country 30 days after you divorce in this situation. What alternative answer do you need?

There would only be a penalty if you are reported or they otherwise find out. However, you have no viable option to immigrate to the USA. You are already in violation of US immigration law. You cannot immigrate through marriage to another US Citizen. Your only legal option is to leave the USA.

You are currently in a period of unlawful status, and the K-type visa has a particular requirement that your adjustment of status occur through the initial petitioner, so since the marriage is terminated, you have no other option than to leave. Be aware that the longer you stay in the USA without lawful status, you run the risk of incurring a longer bar to admissibility in the future. In fact, if you wait more than a couple of weeks to depart, you will already have incurred a 3 years bar to admission in the future. Upon the 180th day of unlawful status, you would trigger a 3 year ban. Since you divorced in July 2008, that 180th day, if not already past, is certainly looming in the very near future. If you have an interest in travelling to the USA in the near future (as in the next 3 years) you'd be wise to consult an immigration attorney to verify that your future permission to come to the USA might be in question, the longer you remain.

Bottom line, you are here illegally. We can not give you advice on how to get around the laws. It would be in your best interest if you leave voluntarily. Getting found and deported is going to be worse.

How are you living now? Alone? Work permit so you can support yourself? If you are self-supporting, a lawyer might offer some advice but there will be a fee. Also, the Catholic Church has special services for immigrants. Otherwise, you need to return to China as soon as possible.

Chia said she came on a K3 and her former husband did not apply for adjustment of status for her (presumably she was means that he did not prepare form I-864 and possibly the fees, since she could submit the other forms) so I don't know how she would have a work permit. Perhaps she is staying with friends.

if you have the money you should save it and bring it back to China, if you really think you can make a case the hire a really really good lawyer to help you battle this out.... you should probably be packing now instead of posting here, every advice has been given... good luck!
