My wife has a friend who has received a K-1 visa. and her husband-to-be is eager to have her change her name to his, and even suggests that she do it as soon as she arrives in the U.S., without waiting for them to get married, if I'm understanding it right.

My questions are:

1. Wouldn't it cause a lot of problems if she were to try to change her name before they marry? How would you even do that? Wouldn't places like the Driver's License office and banks and things insist on using the name on your passport or your I-94?

2. How do you change your name between getting married and filing the I-485, and how do you indicate the change of name when filing for AOS?

1. She will not be able to change her name without marriage certificate. I work for a bank and we definately require name to match her passport or drivers licence. Plus, to change name on drivers licence you need to show either marriage certificate, or a court order, otherwise they go by your passport name.

2. After they get married, she can apply for AOS using her new married name.

I would wait until they are married to change her name, a lot easier, and with the complicated process of immigration, why complicate things more?

In all 50 U.S. States (this means the 50 States, Washington, D.C., Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands, and American Samoa) the bride may take her husband's last name (surname or family name) as her new last name.

EXAMPLE: Jane Doe married John Jones and she may change her name to Jane Jones.
