Hi everyone, need your help!

Daughter of fiance turned 21 on day of approval, then on visa issue date she was denied, along with my fiancee and her other 2 children. So I went to embassy and after waiting 4 hours, spoke with a consulate who approved her and the 2 children, but wanted the famous "more information needed" for the 21 year old daughter.( a detailed chronology of our visa process). He also stated they were not blameless in the delay of issuing the visa.

The short version of the timeline goes like this:

Nov 14-interview, more info needed(the nortarized address of my divorced ex in 2002)

Nov 20-provided the info, result-more info needed( detailed chronology of our visa process and relationship)

Nov 25-approval, also daughters 21 birthday

Dec 2-denial of all visa's

Dec 22-approval of visa for 2 children and fiancee but semi-disapproved for 21 year old daughter(more info needed)

Dec 29-provided the more info needed( the detailed chronology of our delayed visa process, thus creating the delay which also made the approval date later, the same as the daughter's birthday.

Jan 2-final decision of consulate to disapprove the daughter's visa

I have asked the Washington state senator to help, but so far no formal response from her.

Does anyone have suggestions as to what I can possibly do to get my daughter the visa?

My case was based soley on the consulate stating they were not blameless in the delay. But I am thinking that even if they were wrong, it is too much trouble to fix the age out law now!

Please how if you know of any possibly solutions?

Thanks,

Doug

I'm not a lawyer and an expert in this field, but I can tell you CSPA (Child Status Protection Act) law might be applicable in your daughter's case. Numerous class-action lawsuits are pending involving CSPA cases. If you understand VNese, tune in and listen to LS Tuan on Saigon Houston radio every Tue afternoon from 0300 to 0400 PM CST. He's very knowledgeable about this matter.

Thanks DPNH for your info,

I have looked at many of the possibilities, I have no specific direction as of yet. All of a sudden, the knowing that it will take years, is taking all the steam out of this new goal. I did send the WA state senator all the info and am hopeful....she can do the magic.

Appreciate your response,

Thanks again,

Doug
