Yes it does affect removal of conditions.

You can file I-751 as soon as divorce is final, and will need to provide evidence that marriage was in good faith, and can file with a waiver of the joint filing requirement.

If divorce is not final at time tha I-751 needs to be filed, then you will need to file the I-751 jointly with spouse.

Filing if the Couple is Separated

More troublesome is if the couple is still married, but separated or otherwise not getting along. With limited exception, as long as the couple is legally married, it is necessary to have a joint petition. Thus, troubled marriages often need either to be reconciled or terminated in order to file the I-751. As explained below, the I-751 can be filed by divorced individuals, and may be approved, as long as there is sufficient evidence that the marriage was genuine when initially entered into. It is more difficult to satisfy the USCIS in such scenarios, however.

Joint-Filing Waived in Limited Cases

There are two situations in which a person who is still legally married can file the I-751 without the spouse. The first is if the person entered into a marriage in good faith, but has been battered or subjected to extreme cruelty by the petitioning spouse. The second is if termination of permanent resident status and removal from the U.S. would result in extreme hardship to the foreign national. Extreme hardship is a high standard and can be based only upon conditions that arose after the conditional residency was acquired.

Filing after Divorce or Annulment

A conditional permanent resident with a marriage that was terminated due to divorce or annulment must file for a waiver of the requirement of the joint filing of Form I-751. To obtain an approval of the I-751 and be granted unconditional lawful permanent resident status, the conditional permanent resident spouse must be able to show that s/he entered into the marriage in good faith.

The person seeking permanent resident status should expect to undergo an interview at the USCIS about the marriage. The USCIS will closely scrutinize whether the marriage was bona fide at its inception. The USCIS will review the divorce decree and complaint for matters that may be reflective of whether the marriage was entered into purely for immigration purposes or to perpetrate fraud against the United States citizen spouse or the USCIS.

Correct, entry on a spousal visa followed by a quick divorce, looks very much like "marriage for green-card". This is a big reason the green-card is a conditional one.

Gosh if you read his historical posts you see him desperately asking about getting that magic 10 year green card as soon as he landed in the US. I makes me mad that relationships like this just slide through the interview process while completely valid ones get caught in visa hell. He arrived the 18th of November and is talking divorce already.

Yes, Sylvia, like yours and mine. I have known him from a group I belonged to where he made several female members uncomfortable by asking personal questions that should not have been asked if he were truly in love with his wife like he claimed. I only had one conversation with him and that was enough to raise my antennae that something was not quite right with him and I see my intuition was correct. He got a CR1 visa and in Nigeria, those almost always go into AP, especially when there is a big age difference as in he and his wife's case. This makes me even more angrier. And then he wonders why people speak in the manner they do about his fatherland?

I actually felt quite bad for what I said and even apologized for upsetting him. Well since reading this post from him I wish to RECANT my apology. He and many like him are the exact reason why I have questions!!

This is so utterly frustrating. I am in a crying mood, feeling the stresses of the burial at this distance. I filed in 2007 and sit in Visa hell wanting nothing more than to know a date we can be together here while I see people that can't stay together 3 months. I wish they would just replace the interview with a lie dectector and clean up the process. I know there are non contact devices to calulate the honestly in someones statements. Why do we have to out up with all this separation when false couples obviously aren't being prevented from getting their visas. I just pray that those that are not bonifide marriages end up back home with a lifetime ban.

I feel the same way. Its soooo frustrating being away from MY husband when this ####### is here with his wife for such a short amount of time and can't even hold it together for a year (not that the amount of time makes a difference but you know what i'm getting at) and he's already asking how to get his 10 year green card and divorce her. HELLOOOOO. It makes no sense to me. It will be a year since I saw my husband in March and I'm forced to spend money I don't have in order to visit him cuz we can't take the seperation. I know I haven't been waiting as long as some others, but this whole visa process is soooo depressing and then you add to it things like what this galaxy guy is doing and it makes me beyond angry! There has GOT to be a better way!!!!! :bonk: :bonk:

Totally unreal !! I kinda figured this was going to happen. It appear to me that this lovely lady was used.

If your marriage fell apart in that short period of time it must have been an explosive issue that only can be remedied by divorce. But... if that is not the case..read below:

Sylvia: I feel for you. I am about cried out now. Now I have to tighten up my boot straps and get down to business on the next steps to take. My husband's denial had nothing to do with fraud of any type, but with his mother refusing to answer questions. When I really think about it from the embassy's point of view, that can look like there was something to hide. I know the real reason as being that the embassy official did not identify herself so she didn't want to answer questions about her son without knowing. She called very upset asking me to invite the woman back because she felt she ruined our chances of being together. I didn't think it would be that big a deal since she did get a successful interview from my husband's brother, but apparently parents hold a lot of weight in determining the validity of a marriage. I am not sure how we will overcome this, but I will work to find a way.

2Hearts: I am willing to bet that his wife has no clue that he is about to hit her with the fact that he is wanting a divorce. I am also willing to bet that she doesn't know that he is conspiring behind her back.
