January 2009 AOS Submitters

We received the anticipated I-693 RFE Thursday but there is a kicker with this one. They state my wife's medical exam from the Philippines required her to get another medical exam within 6 months of her arrival date in the US!!!! #######!!!! No one said anything about this requirement during the medical exam, her chest x-ray for TB was clear with no additional tests required, no problems were noted during the exam. At her POE in Guam, the immigration officer never stated anything after he took her medical exam. I am really confused about this and of course the fools manning the phones at USCIS were of no help, not even the supervisor. I was told my options were (1) to get the medical exam or (2) to submit a letter with the RFE explaining that there was no apparent problem with the medical exam at the time of the exam or at the POE and hope the adjudicating officer looks at her file before the due date and accepts our explanation. If not, then her case will be considered abandoned and will be closed. Looks like I will have to bite the bullet and pay for another medical exam. I am so tired of dealing with the incompetent fools at USCIS.

i think the xray is no longer enough. all immigrants are required to get the skin test. and that is usually what's missing. try making an info-pass first to find out what specifically is being asked. you could be wasting money for a second exam.

Andy-n-Maricar, I am sorry for your RFE. :( pls check this USCIS Q & A for additional information before you go to any civil surgeon:

Questions & Answers:Changes to the Tuberculosis and Vaccination Requirements Required for Adjustment of Status

an infopass like felb suggested will also be helpful.. but if the immigration officers in your the USCIS office nearest you are like the ones in my area, they would be as lost like the people we usually talk to on the 1-800 (including the supervisor)

i hope everything will be straightened out and they could resume processing for your case.

Andy-n-Maricar, I'm sorry about your RFE but if I were you, I would do what they say and get the new medical exam here. I absolutely agree with you that there are a lot of incompetent employees in USCIS but sometimes it's better not to fight with them proving that they are wrong. I am saying that because I remember the sad experience of some girl that I know from another (Russian) forum. They had exactly the same situation that you have: were sent RFE for medical exam even though she had the valid one from Russia. They sent the polite letter to USCIS which explained why she didn't need the new medical exam... There was no response from them for some time and then they mailed her notification that her case was denied since she didn't submit the required documents!!! :dead: Afterwards they spent a lot of time to open the case again... So, sometimes it is less painful to do what they ask... You may go to infopass but be careful with them since sometimes their right arm doesn't know what the left one is doing :wacko:

just want to share my experience about name change again at ssa.. so before, when i dont have the EAD yet, i went to SSA to change my name into my married name and so i went out of their office with a letter from them saying that they have to verify with the DHS 1st my status before they can issue a card..after 3-4 weeks, i received a letter saying that they cant issue me a card cus my status is already expired. - UNDERSTAND that, since i havent filed for the AOS yet at that moment, so i assumed that when they checked my status i was still under K-1 visa (which was already expired at that moment) thats why issuance of ss card with a name change didnt take place.

so, we filed for aos, waited for ead, ap and interview sched which i all received this march already. i went back to ssa today and showed them the EAD that uscis gave me and a married certificate..same thing, the lady gave me a letter saying that they have to verify my status 1st before they issue a ss card in my married name!

my point is, isnt having an EAD card a VALID DOCUMENT SAYING that the usics recorded my name as *my married name already??? why do i have to wait for another 3-4 weeks????? anybody here experienced the same thing???

Shes, don't worry, I had exctly the same answer when I filed for new SSN on 27 March (after I got my EAD). We are still waiting for it to be mailed. I guess it is the standard procedure in most SS offices, even though I don't understand either why do they need to veryfy our EADs - do they think we stole them or something?! :lol:

It happened to me too! I was gonna get a state ID before they take away my EAD and AP on my 14th interview, so I went to DMV they told me that I can't get one til I've my ssn changed into married name. So I went to SSA office and they told me that it will take 4 weeks to vertify my married name and also take away my card. Now I dun have my card and soon I won't have my EAD and AP too. I mean after waited for months for all of stuff then now I have to wait again! I really wanna yell out loud!

Thanks for everyone's replies. I am leaning toward getting the new medical but may also get an InfoPass appointment, even though it is 100 miles away, just to see if they actually know what is going on.

Things are never dull when dealing with USCIS :(

We went to file our taxes today. I mean my husband's taxes because I haven't been working last year.

So he was decided to go file as single for last year even though we married in november 08. He was certain that he would get more money back by doing that. He knows that he owes the government some money...

But the guy was really nice there and explained us every situation that we could file. And we finally filed as married since that gives him a lot more that what he was expecting. He was suppose to owe them even more if he hadnt file as married. And now they are actually going to send him a check so it's pretty good!!!

But he had to keep my maiden name because I only changed my name on the SSA last week and he said it won't be accurate and they won't find me.
