hi there guys!!! i reaally need help on how to file for alimony and child support...i'm from the philippines...my husband is from nevada, usa. we were married for 2 1/2 years...and my petition was approved last july 2, 2008...not knowing that there's something going on there...he cheated on me...he is now living with this other woman, who has 2 sons with another man...by the way...he cancelled the petition...and i received the cancellation letter from usem...last september...we have a son...who is deeply hurt by his sudden change/decision...he rarely calls his son and rarely send allowance for our son...i suddenly realize that i should file for child support for my son...(i just dont know where to start)...my friend told me...that not only i can file for child support but also...i can file for alimony...we were abandoned..and i was really devasted....it's new year now...and i realize that..i have to fight for our right...i have to be strong for the sake of my son....i've been gone and quiet for a while...but now...it's time to move on....i know i have to...and i can do it!!!

Here in Texas there is a child support hotline that you can call to get help. I know because we have it posted in our work's newsboard. I think if you can google that in your area I think it may be available and would be a good starting point.

This needs to be MOVED to "Effects of Major Family Changes on Immigration Benefits" where it will get the attention and experienced answers you need.

Hopefully when Charles or the other mods get over their hangovers....it'll be moved.

To your issue at hand, it sounds like you've got a very good case. The courts don't look very favorably on abandonment.

Find an attorney...don't worry about the cost...if your husband can afford it, he'll be made to pay.

Sorry this had to happen to you. Jerks like him make it hard for the good guys.

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Go to a local Child Support Services for your state, they should be able to help you. Are you in California?

Was the K-3 visa petition approved in July 2008? Are you still in your native country?

I read your timeline. It looks as if you are still in the Phils, and will not be getting the visa because he withdrew the petition after it was approved. If so, I doubt you have a valid claim to file anywhere although perhaps a Phils lawyer could make noises in Nevada to see what happens.

YES, you definetely entitle to child support and alimony. Since you , I suppose, have copied of married certificates, his information...etc.. they will be able to track him down. Getting an attorney may be the best way since you there in the Philippines and he is Nevada. Not is not fair for you, don't let run away from his responsibility. GO GET HIM, it's the law to pay child support and now alimony.

OLD Dominion, she is entitled for support for her child eventhough she lives in other country. If they have these child together, yes indeed she can get her husband or even ex to support her child.

I expect that only a lawyer would know. She has no standing, so far as I am aware, to file anything in an American court. Yes, ethically she should be entitled to child support but suing for it is another thing. How can she appear in court on her behalf?

You're right. She cant file in Nevada without being a resident. She would have to use some court in the P.I.'s

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Even using a court in the Philippines she is still screwed. No court order in the phils is valid in the US. Being she is neither a USC or a PR she has no rights in this regards. I am very sorry to say that out of country child support is not enforcable. Proving that her child is that of a USC will be quit hard also. I am very sorry to say but your situation is not looking good.
