Can you leave country without AP? Our AP application is pending and we want to leave country by end of Feb. We expect to get AP by that time, but if we don't can we leave the country and have the document mailed to foreign address by someone else in our household? Anybody having any expeirnce/suggestion here.

if u leave the country without an AP ur case get denied and it could happen that they let you not entry back in the us...i wouldnt risk that...

What country are you going to?I went home to the Philippines and stayed there for 5 months without AP.Never had a problem going back to USA.

we don't know what visa you have, that's quite an important fact needed to give advice

09/03/2008 - Received - Signed by SMITH

09/04/2008 - Checks deposited

09/10/2008 - Checks cleared ($1010 + $355)

09/12/2008 - 2 NOA's received (I-130, I-485) - Dated 09/08/08

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

It is not recommended that you leave the country before you have the AP document in your hands. If you leave before it is issued, they could well not let you back in the country, and then you'd have to start all over again with some other sort of visa.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

unless you are on an H or L visa, or a K-3 visa for that matter...

so it really does depend on how the OP entered the country.

Entered on a K1; planning to visit India.

Then if you leave without AP, expect the visit to last as long as it takes to get a spouse visa. The alternative is to go to a local USCIS office and apply for emergency AP. You do pay the separate fee for that.

Technicaly, you don't need to have the AP in hand when you leave, but it must have been approved by then. Someone can bring it to you or mail it to you (risky as things get lost in the mail).

For example, your AP is approved 2/15, but you are scheduled to leave 2/17, that's ok if you leave without receiving it as long as somebody is there to get it to you. This is a risky situation since many things can happen. It can never arrive (lost in the mail in the US), it can be lost in the mail on its way to India, it can have a typo and be invalid, etc. It's up to you how important this trip is for you. The rules say that the AP must be approved PRIOR to leaving the US. It doesn't say that you must have it with you. Nobody will ask for it until it is time to leave India back to the US.

When did you apply? It normally takes 60-90 days to receive, but anything can happen. I wouldn't risk it.

The original poster's AP is pending, probably meaning that the AOS is also pending, thus no greencard.

Don't confuse two very different scenarios, of course you can travel with a green card.

He/she also came on a K1 but has no Green Card in hand, so the AP is necessary in order to come back to the US :)

Yes i know he can't travel without an AP while his case is pending.Just thought he has a GC but still waiting for AP .What i was trying to say was if he has a GC i think he can travel even without it but i am not recommending it.

HAPPY NEW YEAR :star: EVERYONE!!! I FILED FOR MY AP AND MY AOS BUT I DID NOT RECEIVE MY AP INSTEAD I RECEIVED MY GC IN A VERY SHORT TIME. NOBODY ASKED IF THE POSTER'S AP/AOS ARE ON THE SAME SITUATION, THAT'S WHY ONE MEMBER GAVE A SCENARIO WHEREIN THERE'S A POSSIBILITY FOR TRAVEL. THANK YOU!!! :thumbs:
