Hello everybody. I'm concerned about something...around the 20th of Jan I will get to USA, I will get married and apply for AOS and EAD...I was wondering if in the meanwhile (while waiting for AOS and EAD to be approved) I can keep working for my italian office online....would it be a problem since I won't have a work permission or it doesn't count because the job is outside the USA? My boss told me that I can keep working with them trought emails if I want and so I can keep my job from there...I know I will have to declare it when I will apply for AOS on form G 325 so I don't know it this is something that can be done or not... :huh:

If you are working under contract, and your pay is deposited in an Italian bank account, it seems OK to me. Just don't hide it from the USCIS.

The purpose of this law is to prevent questionable aliens from taking jobs away from Americans even before they are approved for residency here. Of course, the law doesn't work...

Yes it will be under contract and the money will keep going to my italian account since I will be using them anyways trought credit and debit card....

You should be fine. With the Affidavit of Support USCIS allows some immigrants to self-satisfy the income requirement if their source of income remains unchanged when they immigrate to the US so they obviously allow for employment under such circumstances. You are not technically working in the US - you are still working in Italy even though your physical presence is in the US.

You are not working under US for this scenario. There is nothing wrong with this since you are not under US payroll.

I used to work in a multinational company from the philippines. I was hired in the Philippines though my manager and business group are from the US. I report directly with the US group. All of the projects i handled are monitored by my US manager up to the vice president from the US.

I mentioned this scenario during my visa interview in the philippines. As per CO, I dont work under US.

It is not a matter of how the income is earned or who pays it, it is that her status is not work-authorised. However, that being said, unauthorised work is usually forgiven when married to a USC and applying for adjustment of status.

That is what I was thinking even if I was hoping the opposite...I don't wanna have problems after everything we had to go trought to be together....I will probably fire myself and see if I can get under contract again after I get my EAD. Thanks for your help!!!
