Hello Guys,

I am a US Citizen and well over 21 years of age. I want to file a petition to bring my Sister, her spouse and their Two chidren ( One is 3yrs old and second child is 7yrs Old at the moment) to US. Here are my questions to you. Please kindly advice

1. Do I have to file separate Petitions for my Sister's spouse and their Children ( I think asnwer is NO but would like to confirm with you guys).

2. If answer to Q1 is indeed a NO, how do I bring sister's spouse and Children along? Is there anywhere on form I-130 I need to mention spouse and Children? (This one part about spouse and Children of Sibling is confusing the heck out of me)

3. I went to India on a vacation and brought following documents from my Siblings.

a. My Sister's Birth Certificate that shows both our parents name. We have same father and mother. (Transalated in English)

b. Copy of my sister's Indian Passport

c. My sister's Children/spouse's birth cert and copy of passport

Is there anything else I am missing here?

I believe I will have to file I-130. Please advise.

You just need to fille I-130 for your sister and include her husband & childrens' names on the same form in section 17. When a visa is available for her, they will all automatically get included in the application. This is taking about 11 years or so, I believe.

Regarding the documents, all you need to submit at this point is the birth certificates of yourself and your sister. They might ask for additional proof such as school record/certificates etc at a later date.

I double check the I-130 and as you mentioned, section 17 should be filled out to include Sister's spouse and Children. That certainly is a huge relief as it does not require to file separate petitions for each family members of siblings! I also went through Guide section on VJ regarding this matter and it pretty much has similar info.
