I am new at this so forgive me , i need someone to talk to who has been through a similar experience, I met my fiance in 2003 we got engaged in february 2005, in 2004 he went back to argentina, he did overstay when he was here before, we went through the whole process and went to the embassy on 5-30-2006. thats when they said no to the visa and we had had a visa waiver interview, she said we had to wait until his fingerprints come back and then it would get sent to Peru<--? WE are so scared, the lady was real nice and said it should be ok but it could take up 2-6 months but since we seemed nice she would talk to the man and try to get it soon, has anyone gone through this what are our chances? We started this with the uscis in august of 2005. I just need some thoughts, I think i am going crazy!!!! :wacko:

You will probably be required to submit a 601 waiver, proving severe hardship to yourself if you had to move to your fiancee's country. However depending on exact circumstances it may require a 212, both are essentially the same forms but apply to different circumstances depending on what happened with the overstay. You can find alot of information in 601 forum that will give you specifics. I am not up on how they handle them in south america so someone else will have to give you more info on that.

More info on waivers and how they work can be found at the National service center website. Alot of data here on length of time and approval chances can also be found. We are going thru the London embassy and they have good approval rating, but can take up to 12 weeks even from there. Hang in there, there are alot of us in same boat with the waivers.

Ohh thank you, Its just nice to talk to anyone who is going through this process. Somedays I feel so alone, even though i know there alot of people in the same situation. We filed the waiver, had the interview, and its now wait time again, Some people I know ask me why I am going through all this, I just cant believe people somedays. When you find THAT ONE, that person you know is for you, how can they ask me that. I am just so happy when i read some of these that have made it to each other, it gives me some hope.

Dwar49 is right. The only thing confusing about your experience is that when they denied the visa, you should have been given the opportunity to submit a waiver and hardship letter to prove the extreme hardship to you, the USC, if his visa were denied and you had to move to Argentina. I'm not clear if you actually submitted a waiver at the "waiver interview".

I would contact the consulate in Argentina to find out what you are supposed to submit with the waiver and exactly where to send it - the consulate or directly to DHS in Argentina. WE had to fill out some paper, and have his fingerprints done that day, she said she usually hands out the application and then you come back, but since I was already there she told us to come back at 4 that day and she would do the process with us, i was just wondering if she wanted to see if we were serious, I dont know, both our interviews ended up in crying talking about each other. She was nice but people can be deceiving , I am just crazy scared and I just want to be with him , thank god for messengers and cams!

Believe me I know how you feel. Fiancee and I are going thru the same thing. Sounds like you have completed all the paperwork and submitted it, so now is the hard part, THE WAIT!! Webcam and voice calls are what get us thru this whole thing also. You are a long way down the process and are on the last leg of this hellish journey. Actually envy you that as we are hung up in this IMBRA thing and dont have any idea of long we are going to have to wait.

OK great - you already submitted the Hardship Letter. The only other thing you may want to consider doing is sending additional evidence or documentation to follow it up since they usually require proof of each hardship. This may not be the case in Argentina, but I would still recommend contacting the consulate there to be sure you have been given all of the correct information. It would be such a shame if you were denied the waiver based on not having submitted enough documentation so best to be sure. Remember you are so far down the road in this - not much longer to wait now. Best of luck!

The thing about the hardship letter that accompanies the waiver is that you need to prove extreme hardship to you, the USC, if he is denied and you need to move there. Hardships are things like the unemployment rate in Argentina and your subsequent inability to get a job, along with statistical proof of the rate of unemployment there. Or if you have a medical condition, you can provide a letter from your doctor documenting the care you require along with information that shows you would not receive the same level of care there. So your pictures don't prove your hardships - they prove your relationship. The reason why they shouldn't let him come back in their eyes is because he overstayed a previous visa. The 601 is a sort of pardon. So not to worry you - perhaps in Argentina they don't require this level of information. But I would recommend getting in touch with the consulate and clarifying 100% that you do not need to follow up his waiver application and your on-the-spot letter with additional documentation. I have spent 2 months writing my hardship letter and collecting documentation for Mexico because I know what they require - it's a packet of about 25 pages - so I'm concerned that they didn't provide you with the correct information regarding what is necessary from you. Hope this helps.

I know that it must be terribly distressing for you that at the moment, but it seems like you are doing all the right things and have submitted the right papers etc...

I can't comment on what it is like going through Peru, as I went through London, UK... and as a previous poster said... they have a good approval rate. Our waiver was approved, and now we are together. I just wanted to let you know that you are NOT alone, and there are lots of people here that are incredibly supportive and so helpful, so please if you have any worries don't be afraid to voice them here...
