Did I say I wished spring was here :no: .....this has been the first day I have been without a headache since last week..the pollen has not even started showing up yet dusting the cars and street and blowing in the wind. Had a slight sneezing attack on Saturday. These darn allergies are already given me grief....make it stop :crying: . Anybody else already suffering from allergies?

stop jinxing me, my allergies haven't kicked in as of yet { :bonk: knock on wood}

best advice, stock up on your best allergy meds (along with antibiotics if need be)

and stay prayed up for relief, deliverance, and strength.

Goodnight VJers. I'm down in the dumps now and just came by to vent. I'm trying to buy my own house now, and because I live in Caly, the lender wants to consider my SO debts because it is a community property state. Also, we are separated legally but they say he has to sign a notice saying that he knows I'm buying a house and he lays no claim to it. WTH!!! What I'm so mad at myself right now for getting myself grifted this way. :crying: :crying: :crying: The financial and emotional hole is so deep that I can't believe it. Taxes not paid by him and now this? Argh

California can be a pain that way, but yes he does have to sign off on the house or the house has to be titled in both names. All he has to do is sign a quit claim deed.

#######... He has $33000 in credit card debt. I pay for the car he left with and he owes taxes for using 99 dependents on his W-2. I feel screwed.

States like California assume that the spouse knows everything about the other. If one is a screw up, they assume that both are. Any debt he is considered mine and only if he tells the judge he'll pay for evrything does it split. The car he has I wanted to go get it since its in my name, but until a Judge splits it in property division, then he has a right to it. I never went through this with my first husband as he wasn't a con man or needed meds. However, this recklessness has cost me so much it is not fathomable to me any more. I know there has to be another out there who has been fleeced once by an immigrant and was able to move on and not let their actions drag them down. I'll post in Changes also.

Chispas, I've heard my family in Louisiana (a community property state) say that you can run a public notice (a newspaper add) proclaiming that you are no longer responsible for the debts, etc. of a person. I don't know if this is true...might be interesting to ask other people from Cali.

Also, it might be worth looking into forming a company (if they company could legally be yours alone). A sole proprietorship (or partnership) would not work, because spouses have to participate in the paperwork. But I think an LLC would be appropriate. You could set up the company, and bank accounts. Then have the company purchase the home and later once you are free and clear title the house in your name. Definitely, run this by a lawyer. But I think this is the line of thought I would pursue to see if it panned out.

Thanks for the information. I'll definitely look into this and ask legally about the newspaper posting. I sent information to the DA's office and they never answered and of course immigration doesn't respond either so I believe he's built up his confidence to abscond.

The legal posting only takes care of futre debts not past ones. Put a flag on your credit reports that requires them to validate your ID before issuing new credit that will slow him up. But the legal separation should have stopped new credit from being on your head

I didn't any new credit on my or his credit report and it might just be that he ruined in credit in the one year time period of spending spree. The whole 30+ thousand was created in 2006 and 2007 while we were still living together. I don't know what he did with the money besides buy clothes, but he didn't pay bills or buy me gifts, that's for sure.
