We got an RFE on our I-485 AOS notice listed on the USCIS website yesterday. They said a notice was sent out on June 3rd 2006. Both the AOS and EAD where touched on 3rd June (now I know why :( ) and our AOS case was touched again yesterday.. I assume to list this notice on their system!

I’m assuming, unless we forgot to sign something (which I doubt) that the RFE might be for either, a co sponsor or they want a complete medical done.. even though their rules state that a medical is not required if a medical was completed within the past year (which it has). We did include the medical supplement with our AOS package and triple checked everything.. all the correct documents where included.. :huh:

I know it sounds negative but.. I’m leaning more towards the co sponsor thing right now as my wife has only been making 125% over the poverty line since last summer, she was with me the year previous and before that she was still at university outside the US.

I suppose I wont know what the RFE is for until we get a notice in the mail :( .. but if it’s either of what I suspect it might be.. then I should just give up on staying in this place, it isn’t worth it! At least back home Melissa’s immigration process would be over and done with, within a week if not sooner and she’d be allowed to work almost right away! :blink: This whole "system" is a pile of $hite.. long & drawn out.. I've already had more than enough of it! :angry:

Try to keep your chin up, I got 5 emails the other day saying an RFE was sent, I suspect for the same reasons. They must be on an RFE kick or something :)

It too sent me over the edge a little bit, but I'm going to try and stay calm and just give what they want, I hope you sort yours out quickly :thumbs:

I think the most frustration is that other countries make this immigration process so easy that we double our frustraton over the complexity of it --- I also wanted you to know that I love Father Jack, My hubby got me hooked on that series ---- Drink?

Don't worry, my RFE was for the medical

(I thought it was sufficient to bring it to the interview only)

and it only delayed the process by like 2 weeks.

October 30, 2005 - Married in Vegas

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 1, 2006 - AP touched

March 4, 2006 - AP received

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

Well if it’s the medical we’re well out of luck to put it nicely! If it’s the co sponsor we’re just as out of luck.

I’m glad it didn’t delay your case too long, problem we really have is that we just cant afford to fork out 100’s more for a medical that the USCIS rules state is not needed :angry: ! I’m honestly fed up (I’m sure like a lot of people) forking out all this money in fee’s to the US Government and their appointed medial centers and the only thing we seem to be guaranteed in return is essentially.. a take what we give you (fee's & forms) and shut up or pack up and get out type of attitude if we don’t comply with what we’re told to do. I really need a job right now not an RFE..

I’m pissed at the waits, fee’s, processing times most importantly not being able to work! If anything you would think this so called process would have the provision to WORK while you wait and or are processed! :angry:

Aiden, I received an RFE last year requesting the medical exam be completed, and we immediately called our State Senator (Elizabeth Dole, R, NC) because I had already had the medical exam before I left Canada, and had completed any and all required vaccinations/titres. As I had followed the rules as they spelled them out, I was rather more than annoyed that they'd send us an RFE.

Senator Dole's office was more than kind in getting to the bottom of it for us. They found out that USCIS had "misplaced" my medical file that they had received when I came thru the POE. They managed to locate it and I did NOT have to endure the cost of a second exam. With the Senator's office help and a letter from me in reply to their RFE, I successfully completed the AOS process and got my Green Card in February of this year.

Once you get your RFE letter and you know for sure what the issue is, get your Senator's immigration liase office involved if you need to. Sometimes I do think that USCIS is just in it for the money :P

Some were informed that an RFE mail was sent on June 2nd, others - like me and you - were informed that an RFE mail was sent on June 3rd. I haven't received this mail yet... The others said the same thing.... So I was thinking: either their system went nuts and that happened or they are requesting something new, that none of the forms asked for it. I sure hope the first one is right!!!!

Some were informed that an RFE mail was sent on June 2nd, others - like me and you - were informed that an RFE mail was sent on June 3rd. I haven't received this mail yet... The others said the same thing.... So I was thinking: either their system went nuts and that happened or they are requesting something new, that none of the forms asked for it. I sure hope the first one is right!!!!

When you give them what they need for the RFE it usually gets them moving on your file - in fact the fact that you GOT your RFE means they were working on your file and it wasn't just sitting in someone's pile someplace. If the RFE IS for a medical it's really relatively simple to fix - a medical doesn't cost a thousand dollars - if you had one in your home country and you have your vaccination certificate so they can transfer the information it's a mere formality. Mine took me thirty minutes (most of which was sitting and waiting) and cost a hundred and fifty dollars.

I know it's frustrating, but your case is really moving quite quickly compared to some peoples...
