Form I-129F Part C #2

Hello everyone!

After 8 touches when I thought today was the day I was getting my NOA2, I got an RFE instead. Today I got the email notice for it, so should be receiving it in a few days. I think I may know what it is for after reviewing this wonderful thread. It might be for Part C #2, where you have to answer "yes" or ''no".

The thing is that I hired an attorney for the paperwork, and when I sent in my I-129F in August 2008, the form I used was this one: Form I-129F revised 11/24/06, and now, when I look at the USCIS website, the form is UPDATED as: revised 07/30/07 and the one prior to that (11/24/06) does not contain a section for the "yes" or "no" in part C #2, the newer updated 07/30/07 one contains this part to answer "yes" or "no".

Other than this reason for the RFE I cannot think of anything else, especially after extensive research here on VJ, nothing else comes to mind...so I will post back once I get the postal mail notice and hopefully I will be able to send back to CSC whatever they requested the day after, if not the same day, I was really hoping for my NOA2, and this RFE was a rude surprise!

Anyone else get an RFE for the reason I mention above?

You may have sent a copy or not signed it. Hard to say.

Part C

2. Have you ever been convicted by a court of law (civil or criminal) or court martialed by a military tribunal for any of the following crimes:

[and then it lists 3 points as bullet points]

Then there is a box for marking either yes or no.

But the form I filed with: I-129F updated 11/24/06, had a different format to this question, it lists:

[and then it has the 3 points BUT WITH A BOX TO CHECK MARK before each point]

There is no box for marking either yes or no.

UPDATE:

I received my RFE letter today, it was for Part C as I had presumed, sent the response back right away...now awaiting NOA2.

My fiancee passed her interview along with her daughter on 2-20-2009 Friday, and it is a great load off our shoulders. Our journey is still ongoing, but marriage and happiness is surely near. It was all worth it and good luck to all of you out their.

We are waiting for the Visa to be mailed to us by Air21 and should get it in a few days. Happiness is one of the greatest virtues in life, so with this life enjoy it to the upmost!!!!!

Ok I feel so stupid now. I received notification of an RFE being sent to me on 090116. I am waiting for it to see what I need to answer. Low and behold I am reading your post about part C of the I129f and I could slap myself. I thought all of Part C was for Military serving overseas, so I never answered 1, 2 & 3 of part C. Did I do wrong? Looking at it now I think that is the reason for my RFE. I will wait and see. Thanks for any info anyone can give me.

That is a very common thing that people overlook. They read military, say no, and skip on to the next section. That is the reason for your RFE.

Can anyone tell me if this is normal. Should only take two to three days from California. Has anyone had this problem before? GRRRRRRRRRRRRRRRRRRRRRRR

Will they send it to you or the attorney you wasted money on? Really, you gave money to an attorney and they flub up something this simple? Why should you have been reading and intrepreting this? Isn't that what you paid this "professional" for? If they send it to the attorney it will take another few days for it to get out of his "in" basket as he does his other attorney work and you wait. If they mailed it directly to you, being "sent" on the 16th does not MEAN it was put in the mail. It means the clerk put it in his "out" basket and it took several days to get to the mail room, put in an envelope and actually put in the US mail. As far as the clerk is concerned, he "sent" it. Actually he put it in the "system" to be sent. I live WITHIN SIGHT of the VSC and it has taken 1-2 weeks for me to receive mail they have sent to me. If anyone except government mails something within Vermont it arrives the next day, if the government is ending it takes 1-2 weeks.

See if you can get some of your money back from this attorney and do it yourself.

Finally received RFE in the mail 1-26-09. It is what I thought, not answering Part C 1, 2 & 3. So I answered and replied to RFE and it is in the mail. Hopefully I get our NOA2 SOON SO we can move on to our VISA.
