Hello,

I am about to send my i 130, What do i show for this? My wife is a british citizen in UAE. How do i prove this? Will a jt account in Dubai be good enough? What else can i show? Also, she is british but lives in UAE, so when the interview time comes, where will she give her interview?

Is she a legal resident of Dubai?

We sent e-mails, pictures, letters to and from inlaws, cards, chat logs. Anything to make the adjudicators job easier!

Shes working thr on a work visa and she has a residense card of UAE aswell but she is not a citizen thr.

I was thinking of sending the following:

Phone Log

Skype chat log

Pictures

Emails

Cards

Jt bank account in Dubai (I just made it for this a week ago).

We didn't send any chat logs etc. will save that for the interview. We did send about 10 photos showing our wedding(including one with his family), honeymoon, etc.; copy of marriage certificate, passport copy showing my Nepal visas, document showing that he is beneficiary of my life ins. policy at work. We will save the bulk of the photos, chat logs, phone records, hotel receipts, ticket stubs etc, for the interview.

aside from marriage certificate, birth certificate of our child together, sworn affidavits of people knowing about our marrige what else can we put with the I 130? but the photos and stuff could be done later right? chatting stuff and phone logs at the interview?

We got three RFE's for our I-130 that we filed via DCF... They wanted more and more evidence. Maybe because the Philippines is a high fraud country. But eventually we were able to submit enough evidence for our I-130 to be approved. The immigration officer reviewing our case wasn't interested in any pictures. But I don't know about others. It probably varies from consulate to consulate.

Here is what we sent in:

--Our life insurance policy together that states we are the sole beneficiary and it should say the the benefits are irrevocable.

--A joint bank account: we got a certification on the date we both opened the account and another letter stating that the account is still active. Make sure that the certification is on the bank's letterhead.

--5 affidavits of people having personal knowledge about our relationshpi before and after our marriage. (got one from the priest who married us, my OB-gyn, my best friend, our former landlord, & dentist)

--Several documents showing that I was using my married name like: my social security card, my Washington state driver's license, my school records, plane tickets, US passport, school ID, etc.

--A letter from school that I have been using my husband as my emergency contact. And a letter from my husband's former employer that I was his emergency contact

--A copy of the deed and land title for land that we acquired together as a married couple.

--The deed of sale for our car and car insurance (but the immigration officer told us that anyone can have car insurance and own a car together)

--Letters and Cards we gave to each other.

I can't remember what else we passed in though....

We also had more documents for the interview to show evidence of a bonifide marriage (pictures, phone bills, etc.).

since my taxes arent filed yet for this year and i am new at my job...could i ask my employer to make a letter saying that i put married on my taxes? anyone have a sample for this?

Nothing, absolutely nothing for DCF in Australia.

I prepared a folder full of evidence such as linking of bank accounts, insurance policies, affidavits from friends & family, tonnes of photographs, joint boarding passes & hotel bills, etc. Took them along when my husband (USC) and I went to file my I-130 (petitioner has to file in person there). They said it wasn't required and to bring it back when I had my interview. So when my interview rolled around I lugged the same folder & photo albums down to Sydney with me and simply going by our marriage certificate & application forms the consular officer said that "our relationship sounded like a genuine relationship" and that he "doesn't need to see them". I was a little annoyed that I had put so much time & effort into assembling everything but oh well... I suppose Australia is a low fraud country. Besides I can re-use everything (and more) when I file to remove conditions

Yes, what is needed varies. I usually encourage people with straight forward cases, particularly in VWP or other low fraud countries to simply include the marriage certificate. When there are red flags or other concerns about the case, they need to be addressed intelligently by front loading the petition with evidence addressing the red flags.

I'm helping my now brother in-law prepare the I-130 petition package for my wife's sister as beneficiary. This case has some issues to address, so we'll be including some evidence of bona fides with the petition. They'll fall in the category of "any other evidence". The red flag (for China, wouldn't be for Australia) is that this Chinese beneficiary's sister (my wife) recently immigrated to the USA. We'll need to overcome concerns the second sister's relationship is for immigration purposes only. Fortunately, the couple met on the internet and can document almost daily communication for eight months prior to their marriage in China. We'll include logs of their Live Messenger chats, some examples, phone records, receipts for flowers, pictures of the couple with family in a few locations on different days, receipts and pictures from the honeymoon and a screen shot of them talking with us on the webcam. I suspect the additional evidence will be no more than about 20 sheets of paper but it should adequately "front load" the case file with sufficient bona fide evidence to put to rest most of the concerns about fraud.

Additionally, the beneficiary will be well prepared for the interview with truthful concise answers about how they met and any involvement by my wife and I in the evolution of their relationship, as well being well informed about her husband's family and personal history. There will also be at least one additional visit during the process, even if it is not until interview time. Fortunately, this beneficiary was with my wife and daughter in Guangzhou for their interview in 2006, so she's already intimately familiar with the procedures.

We're still open on the issue of CR1 vs K3 and will get an additional set of G325a signed just in case. I anticipate sticking with the CR1 unless there are new developments in the next few weeks. It will be CSC thankfully.

wow really?

considering they take your phone and everything else at security.. would they take the packages of evidence too?

i was thinking of taking a whole package of photos, phone bills, emails etc.. and its enough to be heavy.. but i wondered if i need it for Sydney?

Interview can be done in UAE, just like me I'm a Filipino but I'm currently living in Saudi Arabia.

i dunno....when i filed the i-130 i followed its instructions to the tee, and only submitted the translated copy of our marriage certificate (which was notarized, of course), an affidavit from sis in law and i think that was it...and i wrote a letter (cover letter of sorts), and i got approved. guess it varies, i wouldnt send pics and stuff though, i was told by USCIS they dont want pics....

but maybe send it the other stuff, and have you considered calling them directly as well to ask?

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

its hard to have something more if you dont live together

We are trying to determine which route to go. Would you let us know what made you file for the IR-1/CR-1 instead of the K-3?
