DCF time in Country

Hello, I'm beginning the application process with my fiancee, who is from Algeria but living in Spain. We are having a lot of difficulties with the fiancee visa, mainly because he has an overstay in Spain, and is concerned that Algeria will punish him by taking away his passport for 5 years when he returns.

I have just begun to consider the DCF, however time is really of the essence since I'm beginning medical school in August and cannot take a vacation once that starts.

I know that I would have to go to Algeria for the marriage and to file the I-130, but after that could I leave?? And have my fiancee take care of the rest.

DCF is usually reserved for those US Citizens who are residents in the country where they apply. However, some consulates will take non-resident DCF cases. The only way youre going to find out if Algiers is one of those posts is to contact the Immigrant Visa Unit there and ask them. Read the DCF guide for tips on what to ask and how to approach it. But don't be surprised if the answer will be negative.

If he is in Spain now, why are you talking about Algeria? Shouldn't he just stay in Spain? Have you contacted either of the Consulates to find out their DCF filing guidelines? Is there any truth to the fear that Algeria can hold him prisoner for 5 years? For breaking another country's immigration rules?

At any rate, for a DCF case, the USC is required to be in the country to file the I-130. After that, the rest is a visa application case that the foreign spouse can handle on their own. The USC is not required at any visa interview that I'm aware of.

Yes, multiple threads going.

Madrid told her they'd take the case.

Athens was really only interested in knowing how long the DAH had been living there & did he rent or own (no bias toward renting). Never asked for his police stamp or my 500euro residency permit. I often fantasize about what I could've spent that 500 on.... <g>
