Hi, I recently got married and I've been here in the US for 3 months now. We filed for AOS the last week of Nov. But I still haven't received my biometrics and interview date. My problem is that my wife doesn't love me anymore because she has found someone else. It is really so painful and I don't know what to do anymore. I got here through a fiance visa, we got married and filed for AOS. To what I understand, if the marriage won't work then I must go home so I won't be permanently ban here. I want to stay here for the sake of helping my family but at the same time I'm scared of the consequence of staying here. What should I do? Please help me because I'm really so confuse and miserable.

i got questions..

- how did u know she doesn't love u anymore?? i mean falling out of love cant be that fast.. IMO

- if your wife doesn't love you anymore why did she allow you to file AOS??

I don't think it is confusing. It could simply be a case of two people really not knowing each other well enough in the first place to take such steps together. The problem arises when an alien and a USC meet and fall in love and pursue the fiancé visa so that they can be together. Unfortunately, some couples are not meant to be together and within the first few months of living within the same household the fissures in the relationship begin to form. What to do? Well, each and every one of us recognises that these fissures can mean an end to the relationship, and with a K-1 entrant, if this occurs before the adjustment of status phase is completed, a certain end to any potential for the alien to reside permanently in the USA (barring any relief should he or she be a victim of abuse, that is). There are some USCs that realise that the alien has placed him or herself in a position where they might be uprooted once more if the marriage fails, unlike the USC who simply goes on with life after the marriage is terminated. I can only imagine being a USC in this position. I know I would feel partially responsible for jumping into a relationship with a foreign-born individual without thinking of all of the "what ifs" beforehand...and especially those that the alien, who has transplanted himself in order to spend his life with me, might face if we were not well-suited.

In order to pass the adjustment of status stage of the process, the parties must be in a viable marriage. Viable in immigration terms means without steps to terminate the marriage having been taken. It does not require that the parties be madly in love with each other. It does not mean that the parties need to be in love at all. All it means is that the parties had bona fide intentions upon entering the marriage and that they have taken steps to commingle their lives, and reside in a common residence.

If the couple are able to come to terms with this predicament, and think of the long range goals of each party, this is not insurmountable. I think the OP's wife should rethink her plans to end the marriage at such an untimely stage for the alien. A couple of months delay wouldn't be much of an inconvencience.
