Hi, I recently got married and I've been here in the US for 3 months now. We filed for AOS the last week of Nov. But I still haven't received my biometrics and interview date. My problem is that my wife doesn't love me anymore because she has found someone else. It is really so painful and I don't know what to do anymore. I got here through a fiance visa, we got married and filed for AOS. To what I understand, if the marriage won't work then I must go home so I won't be permanently ban here. I want to stay here for the sake of helping my family but at the same time I'm scared of the consequence of staying here. What should I do? Please help me because I'm really so confuse and miserable.

what's her plan? i believe you can still stay in the us with 3 D's Death of the petitioner, domestic violence and divorce.. your choice. sorry to hear your case dude.

Tough one. If there is a possible way your wife may clean her act up then try to make the marriage work.

What does your wife want? Divorce? or what?

so you are the hubby, so you're in the US for 3 months now, so u filed for AOS last month and you're saying your wife doesn't love you anymore???

i got questions..

- how did u know she doesn't love u anymore?? i mean falling out of love cant be that fast.. IMO

- if your wife doesn't love you anymore why did she allow you to file AOS??

Wait another month for the biometrics appt. letter and then, if you are able, wait another eight months for the AOS interview. How long have you known your wife? Is she your AOS sponsor? How soon after you filed AOS did she tell you this? What is her plan? Can you still try to make the marriage work?

Best way is to get your 2 year GC and then have her divorce you. You can then file to remove conditions and get the 10 year GC. You will be in the clear then.

It's a bit on the shady side but beats going TNT or going home.

Hopefully you will get the 2 year GC without an interview. Otherwise it may be a bit difficult as your wife would have to attend the interview and both of you would probably have to lie to get approval. That would not be a good thing.

Let uscis know she two timing sluz and mess with your case. Have her at least write a letter verifying this.

august 2004 I-129 filed (neb)

DEC 2004 Approved

interview: SEOUL

MArch 21st , 2005AR for special security clearance,washington

May 18th tranfer case from Seoul to Islammabad

June 21st security clearance done

June 28th online at the embassy in Islamabad

waiting for paper transfer and the good word

OCTOBER 14TH 2005 Interview Number 2: ISLAMABAD, PK

AR number 2 sent to DOS per Islamabad (2 cable request)

Nov 22 okd updated financial and etc proof accepted / embassy waiting for security cables

dec 20th one cable back waiting on 2nd

Jan 17th.. good word recieved. SECURITY CHECKS ALL CLEAR!!! DOS says embassy to contact him within two weeks!!!!!!

FEBRUARY 10th, 2006 VISA RECIEVED!!! They called him In via phone, stamped his passort and sent him on his way!!!

FEB 28th WELCOME HOME>>>POE CHICAGO did not even look at xray, few questions. one hour wait at Poe

march 10th marriage (nikkah at the islamic center)

aug 2006 AOS interview, cond 2 yr GC arrived september

June 2008 applied for removal of conditions on permant residency aka awaiting for 10 yr greencard

Dec 2008 10yr green card approved, no interview.

Thread carefully on this. I f you are still waiting for Adjustment of Status based on marriage to her, these are dangerous waters.

You can't unless there is a sustaining marriage. She could wait until your adjustment of status has been approved before making any final decision to divorce. However, you'll have to have evidence that you are living as husband and wife and commingling your assets and liabilities until the application is adjudicated.

People, do not suggest visa fraud here.

If the relationship has soured, and there are no viable "legal" alternatives, the beneficiary must leave the US. Period.

Stall techniques, having a baby and/or attempting to file AOS with minimal time married are not acceptable practices.

Having said that, the AOS may be possible based on a good faith marriage, but this approach does not seem plausible, given the very short marriage.

Diadromous Mermaid is the in-house expert on this issue and I defer.
