At Q 13 if the address is the same shoul we leave gap or write none or N/A or write again the same address from q12?

at Q23 and Q25 there must be the same amounts of money as in w-2?..I mean exactly the same figures...not an approximation..

Do we need to submit form 1099 also, besides w-2??thats' what I see in the instructions...

Thanks a lot!!

Yes, submit all 1099's (if any) along with the tax return and W-2. Basically, whatever income is listed on the 1040 (work income, interest income, investment income, business income, etc) must be accompanied by a tax document.

I don't think the total income of Q23 has to match the 2007 W2 exactly. You might make more income now (than your 2007 taxes show) and would put your current income in Q23 and back it up with payslips or a letter from your employer. Generally I think Q23 should be your right-now current monthly income times 12. A letter from an employer could verify that you have a permanent job at that salary to indicate you will continue to earn at that rate.

Yes, a tax return needs the W2 or 1099 to add to the proof. Anybody could fake up a tax return, so the documents help verify your tax return is real. An alternative is to order tax transcripts from the IRS for free. Then you don't have to send anything but the transcript because it has been verified by the IRS as your true and correct tax info.

What should you submit if you're planning to send this past year's return (2008) within another month's period? It takes about 6 weeks for a transcript to become available from the IRS after filing. Most of my jobs will submit W-2's, but we have two self-employment items to list that will not have W-2's; the closest we'll come is maybe a 1099-MISC, which is handwritten (therefore, what would stop someone from faking one?).

Any advice there?

Edit: What about letters from bank officers? Are those still usable for adjustment of status, or must they be tax documents?

tax transcripts are not required... a complete 1040 (with attachements and schedules) is acceptable... In addition, things such as pay stubs showing YTD earnings can demonstrate current earnings situation...

bank statements and letters from bank officers can be used to demonstrate levels of available assets, but many people simply fulfill the income side of the ledger and ignore the asset side unless there is an income shortage...

YMMV

I'm lost on what you're asking. I know you want to do a new return to help you qualify because I read another post by you. I believe you need to look at the I-864A to go along with the I-864. That's for the person who lives in your household whose income you are going to use to meet the money requirement.

Back to taxes. If you get all your information together you can file as soon as you have all the documents you need. But sometimes you don't receive W2s, interest/dividend statements from financial institutions etc until early February because they legally have until the end of January to prepare and mail those to you. As soon as you get it all worked out and file, then that is your latest tax return. But you don't have to have a 2008 return until April 15 if you don't want to.

Also, have you started reading the tax laws for your new husband? Very complicated, so if you plan to file early, better start learning the requirements. My head is hurting from studying all that yesterday and today.
